As suspected the advice given to Minister Car by the NSW Education Department not to make LifeVac devices available to NSW schools was not based on any legal or legislative facts.
Specifically when the Education Department said that" unless the LifeVac was in the First Aid Code of Practice we could not use it", was a deliberate misrepresentation of the legislation. LifeVac has been in contact with SafeWork NSW who have confirmed that:
- SafeWork would not have provided that advice to the DoE (if they had requested it) as it is inconsistent with the legislation and the Code of Practice.
- SafeWork does not and did not prohibit the use of equipment (like the LifeVac) when a risk has been identified e.g. children + food equals choking risk.
On a positive note, the City of Joondalup Council in WA has voted to install the LifeVac device beside every defibrillator at every facility and public place in the area. Contact has also been made with the WA Education Minister in the light of this decision to the view of schools also being equipped.
