The Issue
UPDATE: The driver posted a new profile picture on his facebook where he goes by a fake name, in which he is holding something that is covered up with an image that says "Blessed" but if you look closely, you can see it is a big gun. You can see the mag and the handle and the back of this gun. A few avid gun owners have told me it for sure looks to be an AK-47. This is the type of person the prosecutor Kelly Cunningham let back out on the streets!! He is awaiting sentencing and is posting pictures with an AK-47!! We need the plea agreement overturned and he needs to be in prison before he kills someone else!! Picture is attached below!! My son, Mason Payne, was shot and killed on August 24th, 2024. It happened following a verbal argument in the Skybridge parking lot in Davenport, IA. As the confrontation escalated, four of the boys involved were leaving the scene when shots were fired into a crowded area, fatally hitting Mason.
Tragically, what was initially a verbal exchange that my son wasn't even involved in quickly turned into a horrific act of violence. My son had so much life ahead of him, and his future was senselessly ripped away by the reckless actions of others. The driver and the shooter of the vehicle had been arrested and charged with 1st Degree Murder. A witness wrote a statement saying that the shooter was not going to shoot, indicating he wouldn't have pulled the trigger until the driver ordered him by saying, "Shoot or I will shoot you."
This critical piece of evidence should be given the utmost consideration. While they both need to face justice, it’s crucial that the instigator receives a punishment just as fitting of the severity of his role in Mason's death. It is not just the act but the instigation and incitement that demands accountability.
The shooter is currently still in jail awaiting trial but the prosecutor without our knowledge or opinion gave the driver a plea agreement dropping the 1st Degree Murder charge and reducing his charge to Solicitation to Commit, Accessory after the Fact, and Interference with Office Acts!! He was released while awaiting sentencing!! He served 327 days, will most likely have 2 years probation, and fines and fees!! This is NOT justice!! This shooting would not have taken place if the driver wouldn't have ordered the shooting therefore causing my son to be shot!!
We seek not only justice but change, ensuring such tragedies don’t befall any other families. The legal system must consider all facets of the incident, ensuring those truly responsible are held to full account.
