Demand Financial Restitution and Penalties for Misconduct by Fox Hollow Condo Board
The Issue
I am a condo owner at Fox Hollow Condominiums in Ruidoso, New Mexico. Since moving in June 2021, I have faced a series of irregularities from the Board of Directors that question their ethical practices. My concerns were initially raised to the Board of Directors on August 3, 2024, and escalated to the New Mexico Regulation and Licensing Department on October 11, 2024. Unsettlingly, I have been invoiced for three infractions since October 10, 2024, all linked to the Vice President of the board whose actions triggered my ethical queries.
The misconduct falls into six major counts of misfeasance and malfeasance including missing invoices from records, withholding records from owners, labeling owners raising concerns as troublemakers, punitive fees assessment without due process, unfair enforcement of rules and regulations, and missing audits of accounting records. These actions violate the trust of homeowners and risk the transparency and fairness expected in a homeowners association.
It's time for real change. We're requesting immediate penalties and restitution for owners who have been unfairly treated. We call for adjudged restitution and penalties set at $500.00 per officer per offence for these counts of misfeasance and malfeasance.
