This petition is now reopened and will be updated to include new counts of corruption and fraud by Rick Scott, his Florida Department of Environmental Protection (DEP) and other state agencies on behalf of the Koch Brothers and other politically powerful polluters in Florida. Our petition previously documented Scott and Jeb Bush's illegal actions that lead to the give-away of Florida's sovereign submerged lands and the waters above them, to the Koch Brothers for disposal of dioxin-contaminated waste in the St Johns River. These actions included using a well-disguised notice to avoid public participation in the permitting of Koch's pollution pipeline from their paper mill in Palatka. Now, Rick Scott's agency, DEP is using this same ploy again in an effort to undermine Florida's water quality protections from toxic chemicals. These are toxic chemicals, many carcinogens, that the Koch Brothers discharge from their pulp and paper mills in Florida. In late June, DEP published a confusing, misleading and according to JAPC (The Joint Administrative Procedures Committee conducts continuous oversight of executive branch actions implementing legislatively delegated powers, ensuring that each action has an adequate statutory basis, that all applicable procedures are followed, and that no illegal rules are imposed on the people of Florida), "incomprehensible to the general public" notice in the Florida Administrative Register. The notice purported to inform Floridians of a public hearing before the Environmental Regulation Commission where Florida's water quality standards for discharge of human health-based toxic chemicals would be "changed". Changed as in, severely weakened, allowing more carcinogens to be dumped and everyone of these new chemical limits would be weaker than EPA recommends. You would not have understood this dire news from the notice, even if you were expecting it. The hearing was held with two of the seven seats on the ERC empty (Scott failed to appoint anyone to represent the environmental community or local governments as the law requires) and a third seat (for a "lay" person) was hurriedly filled by the DEP's general counsel (top attorney) just days after he resigned from his state job. That's what you call a "ringer". He and two other attorneys on the ERC provided the three "sure" votes that Scott needed to seal the fate of Florida's waters and grant the Koch Brothers a free pass for dumping their toxic chemicals. The Seminole Tribe and the City of Miami have challenged these actions with petitions to the DEP for an administrative hearing. Not surprisingly, the DEP has said no way. Now an administrative law judge will decide what happens next. We are adding the US EPA Administrator Gina McCarthy to this petition as she is ultimately responsible for the implementation and enforcement of the Clean Water Act. The US EPA has delegated this responsibility to Florida. Florida is using this authority to block public participation in decisions being made about how state and federal waters are used. We are asking the US EPA to take Florida's Clean Water Act delegation back, to immediately stop this abuse of power and to prevent further degradation of Florida's waters.
