Demand Fair Competition: Stop Amazon’s Anti-Competitive Practices Against Small Sellers

The Issue

To: Amazon CEO Andy Jassy, Amazon Leadership Team, U.S. Federal Trade Commission (FTC), and Global Regulatory Bodies  

 

We, the undersigned, urge Amazon to end its unfair practices that harm small businesses, undermine competition, and exploit its dual role as both a marketplace operator and a direct seller. Amazon’s dominance and anti-competitive behavior have created an uneven playing field, putting countless small sellers at risk of financial ruin while Amazon profits from their labor. We demand immediate reforms to ensure fairness, transparency, and equal opportunity for all sellers on the platform. 

Key Grievances:  
1. Amazon’s Conflict of Interest as a Seller and Platform Owner  
   - Amazon uses its control over the marketplace to prioritize its own products, undercut third-party sellers on pricing, and avoid fees (e.g., referral fees, FBA costs) that small businesses must pay. This allows Amazon to sell identical products at artificially low prices, making it impossible for others to compete. 

2. Hypocritical “Fair Pricing Policy” Enforcement  

   - While Amazon strictly penalizes third-party sellers for pricing discrepancies, it freely manipulates prices on its own products without consequences. This double standard distorts market fairness and harms sellers who play by the rules.  

 

3. Exploitation of Seller Data to Launch Copycat Products  

   - Amazon routinely forces sellers to submit confidential business data (e.g., proof of inventory, supplier invoices) under the guise of “compliance,” then uses this information to identify top-selling products, replicate them, and boost Amazon-branded alternatives. This predatory practice stifles innovation and robs hardworking entrepreneurs of their livelihoods. 

4. Unfair Advertising Costs  

   - Small sellers are forced to pay exorbitant fees for Amazon Ads to remain visible, while Amazon promotes its own products for free. This financial burden cripples small businesses and funnels revenue back to Amazon.  

 

5. Asymmetrical Policy Enforcement  

   - Third-party sellers face draconian penalties, sudden account suspensions, and opaque appeal processes, while Amazon exempts itself from the same rules. Sellers are left vulnerable to arbitrary decisions, with no meaningful recourse.

Our Demands:  
1. Separate Amazon’s Marketplace from Its Retail Operations  
   - Amazon must either cease selling its own products on its platform or create a fully independent entity to manage its retail division, ensuring no access to third-party seller data or unfair advantages.  

2. Apply ALL Policies Equally, Including to Amazon’s Retail Division 
   - The “Fair Pricing Policy” and fee structures must apply identically to Amazon’s own products. No exceptions.  

3. Ban the Use of Seller Data for Amazon’s Product Development  
   - Implement strict firewalls to prevent Amazon from accessing non-public seller data (suppliers, pricing, sales volume) to launch competing products. 

4. Regulate Advertising Costs and Provide Transparency  
   - Offer subsidies or reduced ad fees for small businesses, and disclose how Amazon’s algorithms prioritize search results.  

5. Independent Oversight of Seller Policy Enforcement 
   - Create a third-party audit system to review account suspensions, policy violations, and appeals to prevent biased or retaliatory actions.  

6. Compensate Sellers for Stolen Intellectual Property 
   - Establish a fund to reimburse entrepreneurs whose private-label products were copied by Amazon.
