Demand Congressional Action to Educate Jurors on All Rights Including Jury Nullification
The Issue
Countless American citizens have been denied essential care from the insurance companies we contribute to. We have witnessed the unnecessary and inhumane anguish and death of those we care deeply for. Moreover, there is cause to believe that the accused (if found guilty) fell victim to the same system that has failed tens of thousands of us. It is inhumane, immoral, and should be illegal to sentence a citizen to death when a jury feels they have no alternative due to a lack of full awareness of their rights. One key right being neglected is 'jury nullification' – an option that allows jurors to acquit an individual based on their conscience, even if the evidence proves guilt. Current statutes allow judges to intentionally withhold or mislead jurors regarding this right, and attorneys are also prohibited from informing them. This lack of transparency profoundly undermines the fairness of the justice system, especially in cases with severe penalties such as capital punishment. It's important to note that if fully informed, as many as 80 percent of potential jurors would view nullification as a legitimate right (Sommers, 2011). We, therefore, call on our lawmakers to amend these legal stipulations and ensure that jurors are thoroughly educated on all of their rights, including exercise of conscience where appropriate.
