Important Legal Facts About Salis: Salis Hanrahan entered the United States but was killed before he could ever be prosecuted or tried for any immigration violation. Under American law, this means: The charges are subject to abatement ab initio (dismissed from the beginning). He remains protected by the fundamental principle: “Ei incumbit probatio qui dicit, non qui negat” — “The burden of proof is on the one who asserts, not on the one who denies.” As one supporter correctly noted: “It’s not a criminal offense to exist here. It’s a civil violation.” The U.S. Supreme Court precedent in Arizona v. United States (2012) reinforces that unlawful presence is primarily a civil matter, not a criminal conviction. Because Salis was never tried or convicted, he died presumed innocent under the law just like the Constitution demands. No court ever found him guilty of anything.
