I am writing to you as a concerned member of the public to formally and respectfully request that the Ministry of the Attorney General file an appeal against the sentence handed down to Darris James Wilson.

The conditional sentence of two years of house arrest is demonstrably unfit given the catastrophic gravity of this offense. The actions of the offender resulted in the tragic loss of 12-year-old Sierra Beverly and inflicted permanent, life-altering, and catastrophic brain injuries upon her mother, Naomi Beverly. While the judiciary must appropriately evaluate systemic factors under Section 718.2(e) of the Criminal Code and Gladue principles, public safety, denunciation, and general deterrence must remain fundamental pillars of criminal sentencing, especially where an offense involves reckless driving that destroys human life. In this matter, the offender was travelling 90 km/h in a 50 km/h zone, crossed directly into oncoming traffic, and made no effort to brake before the head-on impact. A sentence of house arrest fails to reflect the gravity of the crime, undermines public confidence in the administration of justice, and profoundly diminishes the value of the young life cut short. The assistant Crown attorney rightfully argued for a four-year federal penitentiary sentence at trial, recognizing that incarceration was the only fit penalty.

With the 30-day statutory window to file an appeal closing rapidly, I strongly urge the Ministry’s appellate review team to review Justice Edward’s written reasons and file a Notice of Appeal to the Court of Appeal for Ontario. The community requires a resolution that honors the memory of Sierra Beverly and provides true legal accountability.Thank you for your time, your dedication to public safety, and your thorough consideration of this urgent matter.

On February 11, 2022, 12-year-old Sierra Beverly was killed, and her mother, Naomi Beverly, suffered catastrophic, permanent brain injuries when a pickup truck collided with their car head-on on Oakland Road near Brantford. The driver, Darris James Wilson, was speeding at 90 km/h in a 50 km/h zone, drifted into their lane, and never hit the brakes.

In September 2026, Brantford Judge Gethin Edward sentenced Wilson to just two years of house arrest.

While the legal system must consider systemic background factors, house arrest for an act that killed a child and devastated a family is completely unfit. It fails to deter dangerous driving, fails to protect the public, and denies true justice to Sierra and Naomi.

The Crown prosecutor originally demanded a four-year prison sentence. 

The Ministry of the Attorney General has only 30 days to appeal this decision.
