DECLARATION OF SOVEREIGNTY

We the People of the United States of America reaffirm the inherent sovereignty of the People as the original source of all lawful authority.

Sovereignty is the inherent authority of every living human being. It precedes government and forms the foundation of rights, identity, capacity, jurisdiction, and lawful governance.

This Declaration affirms that sovereignty exists independent of participation in national or state systems and serves as a statement of principle regarding the relationship between the People and the institutions they establish.

Section I — Affirmation of Sovereignty

Sovereignty originates in the People and preexists all institutions. It is inherent, unalienable, and the ultimate source of all rights and authority.

Sovereignty gives rise to the Nation formed by the People, the United States of America, and to the government created to serve the Nation. All authority exercised by institutions is derivative and exists only through powers expressly delegated by the People through the Constitution, and no other source.

Participation in government does not diminish or transfer sovereignty. Accordingly, government exists to protect the sovereignty of the People, secure natural rights, and maintain constitutional order.

All authority flows from the People. All institutions remain subordinate to that source.

All sovereignty begins and ends with the People.

Section II — Sovereignty as the Source of Rights, Identity, Capacity, Authority, Jurisdiction, and Lawful Governance

Sovereignty is the foundation of all natural rights, identity, capacity, authority, jurisdiction, and lawful governance.

From sovereignty arise distinct identities through which individuals relate to one another, to the Nation formed by the People, and to institutions of governance. These identities reflect the capacities in which an individual acts and determine which jurisdictions may lawfully arise. All identities originate in inherent sovereignty and become operative only through voluntary entry or consent.

Natural Identity
Exists in private capacity as one of the People. It preexists all institutions, is grounded in inherent sovereignty, and is subject only to territorial jurisdiction.

Political Identity
Arises only when an individual voluntarily enters political relationships in public capacity and is governed by political jurisdiction.

Administrative Identity
Arises only when an individual voluntarily enters statutory, regulatory, or commercial relationships in public capacity and is governed by administrative jurisdiction. Political and administrative identity do not arise from territorial presence or residency.

Capacity
Determines the context in which identity is operative and which jurisdictions may lawfully arise, based on an individual's voluntary entry or consent. Private capacity is the natural capacity in which an individual exists as one of the People by virtue of inherent sovereignty. Public capacity arises only through voluntary entry into political, administrative, or commercial relationships.

Jurisdiction
Is the lawful governing authority that arises within defined relationships, determining which rights, duties, privileges, obligations, and benefits apply. It is inseparable from identity and capacity and, except for territorial jurisdiction, arises only through voluntary consent.

Private jurisdiction arises from voluntary agreement between parties acting in private capacity and is limited to the scope and terms of that agreement.

Territorial jurisdiction arises by virtue of physical presence within the Nation or a State and is confined to maintaining public peace, safety, and civil order. It operates in both private and public capacity and does not create obligations other than those necessary to maintain civil order.

Political jurisdiction arises through a voluntary political relationship. Administrative jurisdiction arises through a voluntary administrative or commercial relationship. Both operate solely through consent in public capacity and do not arise from territorial presence or residency.

Consent
Arising from sovereignty, is the organizing principle governing identity, capacity, and jurisdiction. Jurisdiction may lawfully arise only where consent or voluntary entry appropriate to the operative capacity is present. Absent consent, no private, political, or administrative jurisdiction properly arises beyond territorial jurisdiction. All consented jurisdictions must remain distinct, disclosed, and bounded by the scope of authority granted within their respective capacities.
