On Wednesday 24 July 2019, I sat in the public gallery of Court Room 3 of the Supreme Court of Western Australia in Stirling Gardens Perth to listen to DNA experts, Jane Taupin and Dr Brian McDonald give evidence in an appeal against conviction for murder (Scott Austic v R).
Many of you will recall that Jane Taupin travelled from her home city of Melbourne to Koh Samui in 2015 for the purpose of giving evidence in the Koh Tao double murder trial. Tragically, the defence lawyers decided against calling her as a witness but relied on the Thai scientist Pornthip instead.
As a preliminary matter, Jane told the three Court of Appeal judges in Perth of her academic qualifications. She was asked how many times she had given expert evidence in trials in Australia and the UK. She replied that she had done so 70 - 80 times in Australia and 20 - 30 times in the UK. She was accepted as an expert witness by the court and both parties. Her evidence (including two written reports) was not challenged.
It was notable that in listening to page references in reports, one would be aware that there were apparently hundreds or thousands of pages of experts' reports file tendered as evidence. In contrast, the "Unendorsed Report" tendered as evidence in the Koh Tao case from an unaccredited Thai police laboratory consisted of a scrappy table and just 4 pages of notes. It was certainly amateur hour back in Thailand!
It was also notable that in Perth, there was ample room in the public gallery whereas in the Samui Provincial Court there was very little room for any observers and journalists - a fact that the mainstream media largely failed to highlight.
After Jane and Brian finished in court for the day, I had drinks and dinner with both of them before their flights back to Melbourne and Sydney respectively.
Jane mentioned that when she met the Thai defence lawyers, that Wai Phyo had his own independent lawyer(s) and that Zaw Lin had his own independent lawyer(s). I have maintained that separate legal representation was required because given that it is uncontested that they were not together throughout the morning of the murders and that it was only Wai Phyo who was ever in possession of the mobile phone. (Zaw Lin has always maintained that he knew nothing of any mobile phone)
Brian commented in reference to the Koh Tao case that he objects to the misuse of science (ie scientific fraud). He also mentioned that a Thai report included one printout of a DNA profile that had been generated by a machine but that another was simply drawn by hand - (which suggests it had simply been copied by human hand rather that produced by an impartial machine).
