In another callous slap to the face for all who deserve, require, and have demanded justice for David and Hannah, the court ruled that it will not decide on whether or not it will allow the defense team to re-examine the prosecution’s evidence until at least the first day of the trial. Exactly what this means is not clear. It may mean that the defense will NEVER get to re-examine the evidence, re-test the DNA or engage in any acts that will prove that Wai Phyo and Zaw Lin are innocent! As there were no witnesses to these horrible double murders, it is DNA and forensic evidence that will determine the outcome of the trial.
This ongoing pattern of obstructions, backtracking and blockades, commonly documented in many cases in the Thai judicial system, MUST stop! This is a perfect opportunity for the military regime controlling the country to display that they are indeed genuinely serious about eliminating corruption in the country. Why are they wasting this golden opportunity to convince the watching world that they are committed to honoring their multiple promises and intentions to do so? How is the international community able to continue to remain silent whilst the Thai judicial system continues to function with no visible commitment to balanced, fair, transparent proceedings as they've promised to do so time and again? Especially as two young lives are facing execution and the Witheridge and Miller families require and deserves justice, closure and peace versus doubts that innocents will be wrongly executed.There is no ingrained system of checks and balances in Thai judicial proceedings as there is no jury of peers, nor the "presumption of innocence until proven guilty"
As such, we call on, and demand, that the Thai authorities release all of the prosecution’s evidence to the defense team in an immediate and timely manner for independent testing as the court stated and ensured the defense team, and an international human rights monitor, in person that they would do so on April 30th at a second preliminary hearing. At this time the judge also ruled that all of the prosecution’s evidence MUST be submitted to the defense or it would be inadmissible in court during the trial!
We also demand that the UK government officially respond to our petition of over 105,000 people's signatures. They officially accepted our petition at 10 Downing Street on Oct 19, 2014, and yet we have not received a single reply (despite countless attempts to contact them) from the FCO or the PM’s office, nor was there any representative from the UK in attendance at the vitally important preliminary court hearing.
This now puts us in a position that requires swift and powerful action, yet, how are we as a force of concerned citizens to proceed? My personal thoughts are to name and publicly shame all individuals responsible for this sham of an investigation and trial on both the Thai and UK sides.
I know not if this would be productive or counterproductive. I am only completely certain that the way procedures are currently being conducted are utterly unacceptable to the citizens of the world, the decedents and their families, as well as the accused and their respective families; and also including the 4 million other migrants in Thailand who remain exploited and whose future hinges on the outcome of this trial! As It is illegal under Thai law to criticize the court system or a judge’s ruling, those of you in Thailand must be diligently aware of this draconian measure and proceed with the utmost care and personal responsibility as libel, Lese Majeste and defamation laws are heavily and easily abused by any individuals or organizations possessing finances and power!.
