The Village at Wolf Creek saga continues as we close the petition

The Village at Wolf Creek saga continues. Sometimes it's hard to keep track of what's happening, so here's an update from our lawyer, Matt:

On a bright note, on December 11, 2018, the 10th Circuit Court of Appeals dismissed Red McCombs' appeal of Judge Matsch's decision which set aside the land exchange decision that would have provided increased access to begin construction of this massive development. This means that Judge Matsch's decision stays in effect!

However, while we were working through the appellate process, McCombs and the Forest Service were working behind the scenes to develop a new access plan. On July 19, 2018, the Forest Service issued a new decision which would grant McCombs an easement over federal lands to access his parcel. The problem with this new decision is that it relies on the same analysis that Judge Matsch found unlawful!

On July 20, 2018, Rocky Mountain Wild filed a Freedom of Information Act (FOIA) request for records of this new decision and the Forest Service has again failed to provide even one page of information, despite the 20-day statutory deadline to respond. In response, we filed a case in federal district court challenging the Forest Service's violation of our FOIA rights. And around we go...

The fight to protect Wolf Creek Pass continues. We wanted to issue a HUGE thank you to everyone who submitted their objections to the Village at Wolf Creek Road Access Project and those who signed this petition. Even though the Forest Service rejected our objections, it means a lot to us and to the case that hundreds of you submitted your objections.
