The date when my 5-day trial has been and gone...

Michael HartMORDEN, ENG, Regno Unito

2nd November, the date when my 5-day trial was meant to start, has been and gone.

The reason is that the psychiatric report, ordered by the court, eventually arrived at the beginning of last week and stated categorically that I was not fit for trial.

This was not just for my long-running problems caused by the stress of the 5 years of stalking and harassment, but because it was still ongoing with continual acts of witness intimidation by my stalker.

On the basis of that report, the trial could not proceed, but the judge, instead, has given the CPS the chance to challenge the psychiatric report with one of their own before deciding how they will proceed.

They have only until this Friday to make that decision. If they do wish to ask for their own psychiatric report, they have been given a deadline of the 11th of January. This is a bit absurd because the earliest new date they can fix for the trial, if it was to go ahead, is in October 2028.

The only plus in all this is for my stalker to be aware that his continuing criminal activities (witness intimidation is a crime in its own right) will inevitably have put a final insurmountable hurdle on what he was trying to achieve: namely, the final psychological destruction of myself in a 5-day trial.

Maybe now the CPS will finally have to acknowledge the total absurdity of this situation and do something to address the problems associated with the SNT, allowing a known criminal with eleven accepted offences* to bring this frivolous case to trial, not to mention the thousands of pounds of  public money they have squandered in trying to protect their careers at my expense!

* Official police cautions are intended to be used to dispose of low level first time offences, there should never have been a situation where my stalker could accept cautions for 11 instances  of same type of offense, especially against the same victim!

In the UK legal system, this situation is highly unusual and not supposed to happen.
