The events for which I have now apparently been prosecuted occurred 18 months ago followed by 12 months of 'investigation' during which time I was told repeatedly that my extension of bail in breach of PACE was permitted so long as the case was under consideration by the CPS.

I was then told by this officer that the CPS had concluded that there should be no prosecution so that he was obliged to release me from bail and return my property [although that took another two months]. So I had no case to answer.

So why now should I have received this notice of criminal prosecution for an indictable offence?

If we look back in time this officer first came to my attention when he was directed by his Sergeant to serve a fictitious PCN on me in relation to an event which didn't happen. He made such a mess of that that the video of the attempt to serve me has now getting close to 48,000 views on Youtube. 

the next thing I know I am subject to an abusive arrest while lying in bed asleep with this officer physically restraining me from taking appropriate medication when I started to panic on waking up to find him sitting on my bed and holding me down. Because of his organisational failures he ended up by taking away the essential DVR that ran our home security system against a promise that it will be returned almost immediately once the contents have been downloaded.

The search and retention of goods was another breach of PACE in any event followed by another broken promise.

This was followed by two abusive interviews in relation to the first of which my father claimed on my behalf about three separate breaches of PACE and six different breaches of the Human Rights Act, and where the unsupervised intimate search the officer conducted of my person is now the subject of a separate IOPC Investigation where that search is being investigated by them as sexual assault

At both interviews it was categorically clear that the allegations were malicious and unsupported by evidence.

At the end of the nine month permitted of bail. (only permitted because first the Inspector and then the Commander refused to contradict the obvious lies about the ongoing investigation) this officer insisted I remained on bail although unable to provide any legal justification for it and told me that I just had to take his word for it that PACE allowed automatic extension while the matter was under investigation by the CPS..

That was untrue. But if he genuinely believed that then his release of me from bail and the agreement to return my devices is consistent only with the fact that the CPS had rejected the case against me probably for the 4th time If the other emails I had received from this officer were true.

At the time I was released from bail at the end of March this year I had been under police restrictions of one sort or another for over three years. You may recall that in the last break the officer in charge of the attacks on me at that time managed to get restrictions continued against me by starting a civil action for injunction which was eventually rejected by the court.

it was no surprise to me that after two months free from bail this officer and his colleagues gladly seized upon another malicious allegation in order to arrest me again and put me back on bail.

I have no doubt whatsoever that the main purpose of this action is to get me remanded until the trial on court bail, continuing their obsessive fixation in controlling me and knowing that the delays in court system means I will probably be on bail for another two years at least before a trial can occur. 

I am told that a police constable or even a police Sergeant cannot of their own initiative permit the commencement of a private police prosecution without the OK from a Superior officer. I have no doubt whatsoever that the recent promotion of the Sergeant who has supervised his team's abuse of me for the last four years to Acting inspector is not a coincidence. How else do you explain that here I am now, being prosecuted by the very officer who is being investigated by the authorities for his sexual assault on me.

Compare and contrast this with the treatment of the perpetrator who has made my life hell for the last 4 years, evidence by over 700 videos including his most recent physical assault on me fully evidenced on video, who remains free as a bird with no explanation of why there has been no arrest or charge

As must be clear from all the threads on this petition the underlying problem is that the police system of discipline and governance is completely broken.

 The IOPC System in its early stages is neither fair nor independent and takes so long it an not achieve any effective outcomes. In the meantime the PCs and their Sergeants remain completely protected from any intervention by their superior officers all of whom are in effect just admin only and hide behind the mantra that the officer in charge of a case must be allowed to proceed undisturbed. Without discipline imposed from above no system can survive for long and the continuous stream of cases appearing in the newspapers of rogue Officers getting away with abuse for long periods of time Is evidence of this.
