Dear Croatian Parliament, 

We, the Croatian diaspora, are writing this petition because we are asking for the immediate resignation of Kreso Beljak of his duties in the Croatian Parliament and as Mayor of Samobor.  

On January 11th, 2020, in response to a comment by twitter user @renatorancic that from 1945 to 1990 the Yugoslav counterintelligence service, known as UDBA carried out more than 100 political assassinations outside Yugoslavia, Kreso Beljak posted on his official twitter account the following comment in English:

“Over 100??? Obviously not enough. We sow who did the shit and made all the wars from 91. to 99. Fascist in ex-Yu and in other countries who unfortunately escaped UDB-a.”

Therefore, he through a computer system, publicly incited violence and hatred aimed at Croatian people outside the Republic of Croatia Homeland solely because of the fact that they are Croats who, after World War II left the former Yugoslavia as well as their descendants, and he thereby committed a criminal offence against the public order by publicly inciting violence and hatred as set out and punishable under Article 325, Paragraph 1 in conjunction with Paragraph 4 of the same Article of the Crimes Act.

By his abovementioned conduct, the Accused not only justified the murder of Croats outside the former Yugoslavia in the period between 1945 and 1990 but in so doing, he also called for hatred against those persons and their descendants and by justifying the murders that were committed against them and he called upon and encouraged further such behaviour.

A particularly aggravating factor to be taken into account is the fact that this concerns a Croatian politician who is a Member of the Croatian Parliament and Mayor of a Croatian City as well as President of one of the more significant Croatian political parties, and who should know full well that with his positions, he can and does influence a large number of citizens, and can incite them to hatred and violence. 

We respectfully ask the Croatian Parliament to remove Kreso Beljak from all his political duties. In addition, we also ask you to take this simple platform as the basis for building a future which will finally correct the gaps due to years of neglect. We have a new generation of Croats ready to take the helm. Let’s provide them with opportunities and give them responsibilities and resources to make them successful.

Nosotros, la diáspora Croata, estamos presentando esta petición para exigir la inmediata dimisión de Kreso Beljak a sus funciones como miembro del Parlamento croata y como alcalde de Samobor.

El 11 de enero de 2020, en respuesta a un comentario realizado por Renato Rancić en su cuenta de Twitter (@renatorancic), en donde manifestó que entre 1945 y 1990 el servicio de inteligencia yugoslavo, conocido como UDBA, llevó a cabo más de 100 asesinatos políticos fuera de Yugoslavia, Kreso Beljak escribió en su cuenta de Twitter oficial el siguiente comentario en inglés:

“¿Más de 100? Obviamente insuficiente. Nosotros introdujimos a los que lo hicieron y provocamos todas las guerras desde 1991 a 1999. Fascistas en la ex Yugoslavia y en otros países que desafortunadamente escaparon de la UDBA.”

Es por ello que él desde un sistema de computación, incitó públicamente y con animosidad  a los croatas ubicados fuera de su madre patria, la República de Croacia, debido al solo hecho  que, después de la Segunda Guerra mundial abandonaron Yugoslavia al igual que lo hicieron sus descendientes. Por ello, él comete un crimen contra el orden público al incitar a la violencia y al odio, tal como está legislado en el artículo 325, párrafo 1 en conjunto con el párrafo 4, mismo artículo, del apartado de Actos Criminales.

Cómo se mencionara anteriormente, el acusado no sólo justifica el asesinato de los croatas fuera de la ex Yugoslavia durante el período comprendido entre 1945 y 1990, sino que instauró el odio contra esas personas y sus descendientes, y justifica la masacre cometida contra ellos e incita, más aún, a continuar con ese comportamiento.

Un factor que agrava esta situación, y que debe tenerse en cuenta, es el hecho de que se trata de un político croata miembro del Parlamento croata, siendo además alcalde de la ciudad de Samobor, así como Presidente de uno de los partidos políticos más significativos de Croacia y, por tanto, debe conocer cuáles son sus responsabilidades y que puede, y lo hace de hecho, influir en un gran número de ciudadanos, incitándolos al odio y a la violencia.

En conclusión, solicitamos respetuosamente al Parlamento croata que destituya al Señor Kreso Beljak de sus obligaciones políticas. Asimismo, le pedimos que utilice esta plataforma como base para construir un futuro que llenará los vacíos dejados por la negligencia. Hay una generación de croatas lista para tomar el bastión. Otorguémosle la oportunidad, y permitámosle asumir las responsabilidades dotándolos de recursos para lograrlo.

Poštovani Predsjedniče sabora, Članovi hrvatske vlade i Zastupnici u Hrvatskome saboru,

Mi, Hrvati iz hrvatskog iseljeništva, pišemo ovu peticiju jer tražimo neposrednu ostavku Kreše Beljaka kao zastupnika u Hrvatskom Saboru i kao gradonačelnika grada Samobora.

dana 11. siječnja 2020. godine, oko 23,00 sati, putem svog službenog korisničkog računa na internetskoj stranici www.twitter.com na koju se prijavljuje pod korisničkim imenom @KBeljak, na komentar korisnika @renatorancic da je od 1945. do 1990. godine jugoslavenska protuobavještajna služba Služba državne sigurnosti poznatija kao UDBA (Uprava državne bezbednosti) izvršila više od 100 političkih ubojstava izvan Jugoslavije objavio komentar na engleskom jeziku sadržaja:

„Over 100??? Obviously not enough. We sow who did the shit and who made all of the wars from 91. to 99. Fascist in ex-Yu and in other countries who unfortunately escaped UDB-a.“

odnosno u prijevodu na hrvatski jezik:

„Preko 100??? Očito ne dovoljno. Vidjeli smo tko je napravio sranja i tko je pokrenuo sve ratove od 91. do 99. godine. To su bili fašisti u bivšoj Jugoslaviji i drugim zemljama koji su nažalost pobjegli UDBA-i.“

dakle da je putem računalnog sustava javno poticao na nasilje i mržnju usmjerenu prema pripadnicima hrvatskog naroda izvan domovine samo zbog činjenice da se radi o Hrvatima koji su nakon II. svjetskog rata napustili prostor tadašnje Jugoslavije i njihovim potomcima pa je time počinio kazneno djelo protiv javnog reda u obliku javnog poticanja na nasilje i mržnju, opisano i kažnjivo po čl. 325. st. 1., u vezi st. 4. istog članka Kaznenog zakona.

Navedenim postupanjem okrivljenik ne samo da je opravdao ubojstva članova hrvatskog naroda izvan bivše Jugoslavije u razdoblju između 1945. i 1990. godine, nego je samim time i pozvao na mržnju protiv tih osoba i njihovih potomaka te opravdavanjem ubojstava koja su vršena nad njima pozvao i ohrabrivao na daljnja takva postupanja.

Kao osobito otegotnom okolnošću uzima se da se radi o hrvatskom političaru, koji je k tome i zastupnik u Hrvatskom saboru, gradonačelnik jednog hrvatskog grada i predsjednik jedne od većih hrvatskih stranaka, te je stoga vrlo dobro svjestan da zbog tih svojih funkcija može utjecati i utječe na veći broj građana, odnosno može ih potaknuti na mržnju i nasilje.

S poštovanjem zahtjevamo da Hrvatski Sabor uklanja Krešo Beljak i slobodi ga od njegovih političkih dužnosti. Zatim, mi također zahtjevamo da iskorištavate ovu priliku za izgradnju nove budućnosti koja će riješiti političke praznine zbog dugogodišnjeg zapuštanja. Nova generacija hrvatskog iseljeništva je spremna pomoći u napredovanju Hrvatske. Pružite nam priliku, dajte nam odgovornost i resurse kako bismo mogli biti uspješni u pomaganju lijepe naše.
