The Issue

Life can change in an instant, and during times of medical emergencies or end-of-life situations, the rights of a spouse should be unequivocally recognized and respected. My own experience has been nothing short of a nightmare. My husband was admitted to the hospital in critical condition. It was a traumatic time as his family, despite knowing the authenticity of our marriage, questioned my legal rights over his medical and posthumous affairs.

I presented our marriage proof, but the hospital prioritized the wishes of his family over mine. They ignored my decisions, stopped his treatment, and the unthinkable happened; my beloved husband passed away soon after I left his side one morning. To compound my agony, his family swiftly took matters into their own hands, cremated him, and excluded me from his funeral services.

I finally received my husband's ashes after an excruciating period, alongside two death certificates, and had to hold a funeral on the day that marked our marriage anniversary. This experience left me traumatized and in disbelief of how easily the rights of a spouse can be dismissed.

This tragic experience is shared by many others, highlighting a systemic issue where the rights of spouses are overshadowed, especially during vulnerable times. Thus, I urge lawmakers to act promptly and decisively by creating and enacting the Carroll Holland Act.

The Carroll Holland Act will serve as a pivotal piece of legislation to ensure that spouses are granted the indisputable right to make decisions regarding medical treatment, end-of-life care, and posthumous arrangements such as burial or cremation. These are decisions that should be honored without dispute from external parties, safeguarding the integrity of the marital bond and ensuring that loved ones can act in their spouse’s best interests with dignity and respect.

Our laws must evolve to protect those who are most vulnerable during critical moments. By supporting this petition, you are advocating for the rights and dignity of spouses to prevail. I appeal to you to sign this petition and join me in pushing for change, culminating in the creation and successful passage of the Carroll Holland Act. Let us ensure that our voices are heard and that no other loving spouse is ever rendered powerless in crucial moments of decision-making. Sign today and stand with us in demanding this essential legal protection.
