Last April, Christopher Salem, a now-former member of Mayor Victorino's staff, blew the whistle on Greg Brown's Napili Bay "hotel" for violating multiple SMA laws, county codes, and the community plan.
In July, in apparent retaliation for his service to the community, Mayor Victorino terminated Mr. Salem's employment, even though exposing and closing exploited loopholes was specifically what Mr. Salem was hired to do.
A judge denied Corp Counsel's motion to dismiss the wrongful termination suit that Mr. Salem recently brought against Mayor Victorino. And last week the judge also denied Corp Counsel’s motion to block amending Mr. Salem's case to include claims against Planning Director Michelle McLean. So far, Salem: 2 - Corp Counsel: 0 Depositions have been scheduled.
County Departments have since issued violation notices that validate Mr. Salem's whistleblower claims, and now with obvious disclosure issues, Mr. Brown has taken his "Monster Home" off the market.
The image here shows Mr. Brown currently constructing floor area on the third story of a so-called two-story structure - as stamped and submitted to the County by his architect. Mr. Brown failed to disclose that third-story living area in order to get an SMA Permit exemption that he didn't qualify for, worth millions to him, at the same time denying Maui citizens our right to public hearings.
Maui Causes has documented cases where Corporation Counsel intimated County officials from doing what is right for the citizens in favor of private developers’ interests.
Is Corp Counsel currently obstructing the Planning Dept. from issuing additional violations also uncovered by Mr. Salem, and now known to the department heads?
Is Corporation Counsel blocking a stop-work order, and the invalidation and revocation of Brown's improperly-acquired SMA exemption, at Brown's expense?
Planning Director Michelle McLean has stated Brown will "NEVER" get a vacation rental permit for his hotel. Perhaps that's why the Real Estate listing got pulled? (That disclosure could be a problem too if Brown has a construction loan based on vacation rental income.)
Maui Causes will be airing new shows soon that offer solutions to the loopholes and administrative failures that allow this kind of abuse to happen. Stay Tuned.
