Action Alert: Testify this Friday 9am

Just like with Maui's 2014 election victory over Monsanto's millions, Maui's Injection Well case is still going to the Supreme Court, even after our County Council legitimately voted to withdraw.

Outside interests like the Koch Brothers are fueling our Corporation Counsel to lie to you about the Mayor having authority.

Today's council session, including the opinion of the Hawaii Office of Disciplinary Counsel, clearly revealed that the Mayor is the only one who can perform the executive function of filing the papers with the court, but he does not get to determine what the papers say.

The Mayor is just the messenger.

The County Council determines what the message is.

And the council legitimately voted to settle the case, and withdraw the appeal to the SCOTUS.

The Hawaii Office of Disciplinary Counsel testified today that Corporation Counsel and Mayor Victorino are inflating the Mayor's authority.

Corp Counsel's bogus opinion relies on Honolulu's Charter and selectively ignores Maui's Charter which gives additional authority to our County Council when there is a disagreement with our Mayor.

By refusing to communicate the Council's vote to the Supreme Court, Mayor "Mike the Messenger" Victorino and Corporation Counsel are in violation of Maui's Charter and we call for them to be impeached.

Anyone can petition the Court of the Second Circuit for a declaratory ruling on the Mayor's authority, and with that Corporation Counsel won't be able to represent the Mayor anymore.

Nor will Corp Counsel be able to continue giving the Mayor the really, really bad advice that is flowing from big-money outside lawyers who don't give a damn about any of us.

Urge the County Council to procure independent legal council for themselves AND Mayor Victorino, because we all deserve better than Maona Lutey and the Dinosaurs of Corporation Counsel who are so conflicted by protecting past corruption that they can no longer possibly serve the best interests of the people of Maui County.

This Friday, October 18, 2019, the Maui County Council will consider a resolution to hire an independent attorney to represent the Council in the ongoing county “charter crisis” over whether Corporation Counsel and the Mayor can stonewall the Council’s decision to settle the Lahaina injection well case.

WHAT: Support the Maui County Council in securing an independent attorney to represent Maui’s legislators in its dispute with Corporation Counsel and the Mayor’s office over the authority to settle the Lahaina injection wells case.
