Update on our legal fight to save the Fistral Bay Hotel

We are currently appealing the earlier decision of the refusal of the Claim for Judicial Review to the Court of Appeal. We always knew that a Claim in respect of a planning consent from 2017 would pose challenges, however we believe our Appeal is solidly based and has merit.
We are also awaiting the decision of the Cornwall Council as to the most recent application by Acorn Blue which is subject to submissions to the Secretary of State for “Call in.”
Depending on the decisions of both Cornwall Council and the Secretary of State, we will consider further legal proceedings if necessary including but not limited to new Claims for Judicial Review, which can now be within the usually permitted time, together with applications for injunction.
Given the initial open and honest approach we have consistently taken in our dealings with the Interested Parties, we are sorry that rather than work with us, Acorn Blue instead tried to act as a broker offering us other sites on a “finders fee” basis.
The legal position now is as a result of other parties’ reluctance to accept that most local people prefer if given the choice, the restoration of the Fistral Bay Hotel rather than yet another Airbnb apartment block or apartments that most local Council tax payers cannot afford.
The loss of many shops in Newquay Town Centre is evidence of the erosion of the local economy, whilst the loss of many hotels signifies the escalating demise of the tourist industry.
Employment in Newquay, especially after the Coronavirus pandemic, now depends on the preservation of the town’s iconic assets.
We must oppose further high rise apartments from being constructed and save the Fistral Bay Hotel and many others under threat.
