The Issue

*Section 1. Purpose*

This Act aims to address substance abuse by providing mandatory minimum rehabilitation sentences for individuals convicted of possessing Scheduled One controlled substances.

*Section 2. Definitions*

- "Scheduled One controlled substance" refers to substances classified under Schedule I of the Controlled Drugs and Substances Act (S.C. 1996, c. 19).

- "Rehabilitation program" means a court-ordered treatment program focusing on substance abuse treatment and education.

*Section 3. Mandatory Sentence*

(1) Any person convicted of possessing a Scheduled One controlled substance shall be sentenced to a rehabilitation program for:

- 30 days for the first conviction

- 60 days for the second conviction

- 120 days for the third conviction

- And so on, doubling the sentence for each subsequent conviction

(2) The court may order additional treatment or supervision as deemed necessary.

 

Section 8. Provincial Rehabilitation Facilities

 

(1) The Government of Canada, in cooperation with the provinces and territories, shall establish and fund secure rehabilitation facilities dedicated to the treatment of substance addiction.


(2) At least one rehabilitation facility capable of accommodating no fewer than 2,000 patients shall be established in each province.

 

(3) Each facility shall provide:

medical detoxification services;

addiction treatment and counselling;

mental health services;

vocational and educational programming;

relapse prevention programs; and

post-treatment reintegration support.


(4) Facilities established under this Act shall comply with federal and provincial health, safety, and human rights standards.


(5) The Minister shall develop implementation and funding agreements with the provinces and territories within 24 months of this Act coming into force.
