Libérez Khaled Drareni

Le journaliste Khaled Drareni vient d'être injustement condamné à trois ans de prison ferme pour avoir exercé son métier et ses droits constitutionnels de citoyen, droit d'expression, droit d'aller et venir. Rien dans l'acte d'accusation ni dans le dossier à charge ne justifie au regard du droit algérien un jugement aussi inique.
Nous organisations et citoyen.ne.s membres du Collectif de la Société. Civile pour la Transition Démocratique  exprimons avec force notre consternation et notre révolte face à cette décision qui bafoue les règles et les principes les plus élémentaires d'un Etat de droit. Nous réaffirmons notre pleine solidarité avec Khaled Drareni et exigeons sa réhabilitation et sa libération immédiate.
L'injustice qui frappe Khaled Drareni est là pour nous rappeler, si besoin était, que le Hirak, le mouvement citoyen est plus que jamais nécessaire pour qu'émerge enfin en Algérie un Etat de droit et une démocratie.

FREE KHALED DRARENI

The journalist Khaled Drareni has been in prison since March 29, 2020.

The accusation chamber near the Algiers Court of Appeal decided on Wednesday March 25 to quash the decision of the investigating judge of Sidi M'hamed, to put the journalist Khaled Drareni under judicial control, and to issue a deposit warrant against him.

Noting that the facts alleged against Khaled Drareni during the various interrogations he underwent and of which he has publicly reported, are exclusively related to the exercise of his profession;

Recalling that article 50 of the Constitution guarantees freedom of the press and prohibits the imprisonment of journalists for press offenses, even if in the case of Khaled Drareni this offense is covered up behind the unfounded accusation of incitement to gather public;

Noting that the issuance of the deposit warrant against Khaled Drareni takes place in a context of manifest instrumentalization of the judiciary which arouses general indignation in particular in this context of health truce. The Algiers Court of Appeal notably distinguished itself 24 hours earlier by an unfair attack on the functioning of justice by convicting a political detainee without trial, in what has become a state affair;

Observing that the global trend, recommended by the UN, in the context of the Coronavirus pandemic is to empty the detention centers of all defendants who can await trial at home, the Court of Algiers has been strenuously suspicious to return to prison a journalist who presents all the guarantees to await a free trial.

Considering the intrusive nature of the security and judicial harassment of which Khaled Drareni is the victim, we call for the immediate release of journalist Khaled Drareni and the end of all criminal proceedings against him.

His only wrong is to be a professional reporter covering the protests of the popular Hirak, and this since February 22, 2019.

Despite our confinement, we remain mobilized to remind by all means the Algerian State of its obligations to protect the physical integrity of its citizens. The incarceration of Khaled Drareni for his work as a journalist and his dangerous overexposure to epidemiological risk in addition to the deprivation of his liberty will remain a black spot for the regime, the cantor of the "New Algeria".

This task is all the more added to the arbitrary and unacceptable detentions of journalists Sofiane Merakechi and Saïd Boudour.

The Algerian journalists have paid a heavy price to maintain freedom of speech during the dark decade of the 90s. We are still here and we will not let such a forfeiture continue.

Journalism is never a crime !

بيان من اجل سراح خالد درارني

 

 

لقد تم اعتقال الصحفي خالد درارني في السجن يوم الأحد 29 مارس 2020.

 

قامت غرفة الاتهام لدى مجلس القضاء الاستئنافي بالجزائر العاصمة يوم الأربعاء 25 مارس بإلغاء قرار قاضي التحقيق بمحكمة سيدي محمد. في الواقع، محكمة الاستئناف الجزائرالعاصمة أعادت وقع الصحفي خالد درارني تحت رقابة قضائية وامر بالسجن.

 

وإذ نلاحظ أن الوقائع المنسوبة إلى خالد درارني خلال الاستجوابات المختلفة التي بلغ عنها علنا، تتعلقن حصرا بممارسة مهنته رغم وصية مادة 50 منالدستور التي تضمن حرية الصحافة والتي تحضر تخضع جنحة الصحافة بعقوبة سالبة للحرية. لهاذا السبب، تمت تغطية الجريمة المزعومة لخالد درارني بتهمة التحريض على التجمع. 

 

ان الأمر بالسجن ضد خالد درارني تم باستخدام واضح من القضاءبطريقة ان تثير السخط العام خصوصا في السياق الصحي العالمي الحالي: قامت غرفة الاتهام لدى مجلس القضاء الاستئنافي بالجزائرالعاصمة بانتهاك خطير بالنسبة للحق في المحاكمة العادلة من خلال إدانة معتقل الرأي كي تسبح قضية بصفة سياسية.

 

نلاحظ أيضا أن رغم وصية منضمة الأمم المتحدة، في موضوع وباء فيروس الكروانا، بتخفيف من عدد السجناء في المرافق ومراكز التوقيف  و مناشدتها للحكومات بالحد من اكتظاظ السجون من أجل منع انتقال كوفيد-19، لقد اصرت محكمة الاستئناف الجزائرالعاصمة بحدة ادانةالصحافي في للسجن مهما انه يقدم كل الضمانات من أجل انتظار محاكمته في إقامته وفقاً للقوانين.

 

وبالنظر إلى الطبيعة الانتهاكية للمضايقات الأمنية والقضائية التي تواجهها خالد درارني ، فإننا ندعو إلى السراح الفوري عنه وإنهاء جميع الإجراءات الجنائية ضده.

 

نذكر أن خالد دراني لن فعل شيئا سوى الإعلام عن مطالب الحراك الشعبيي، و ذالك منذ 22 فبراير 2019.

 

بالرغم من الحجر، لا نزال بنداء الدولة الجزائرية بالتزاماتها لحماية سلامة  المواطنين.

إن اعتقال خالد درارني بسبب عمله كصحفي وتعرضه المفرط لخطر الوباء الحالي بحرمانه من الحرية سوف يظل كبقعة سوداء في تاريخ السلطة الحالية اللتي تتقدم وصفها كأنها كانت "الجزائر الجديدة".

 

تضاف هذه البقعة على كل الاحتجاز التعسفي الأخرى كالصحافيينسفيان المراكشي وسعيد بودور.

 

لقد دفع الصحفيون ثمناً باهظاً للحفاظ على حرية التعبير و على الحق في الإعلام خلال العشرية السوداء. لا نزال هنا ولن ندع استمرار ما تمثل هذه الحزمة.

 

ممارسة مهنة الصحافة لست جريمة أبدًا.
