Replies from Trinity and Bellway with regards our petition

Hi all, Thank you so much for your support and the messages you have posted with the reasons why you think gates is the solution to our problems. I have followed up with Trinity and Bellway and you can find their answers bellow. Although they both say installing gates is not an option I'm still following up with them, our counselor and MP to make sure we address this and find the most suitable solution (not just additional CCTV) I'll keep you all posted. ==== TRINITY'S REPLY ==== Thank you for your email; unfortunately, I have not been in receipt of an email from Change.Org and was not aware of a petition until your email below. Our role as Managing Agents is to ensure compliance and manage the terms of the Lease and to maintain the communal areas. We were not involved at all during planning or construction stage and we simply manage the development as it is handed over to us by the developer. I have previously spoken with Bellway Homes, the developer, and the Local Authority who have advised that as part of the planning approval for the development, public access from the leisure centre to the residential development was needed and the installation of gates would be rejected and not considered by the Local Authority. As a result of this advice, we would not be able to carry out these kind of improvements, regardless whether it allowed us to recover the costs of this through the Service Charge. If you want to continue to take this further and/or dispute what was stated to you at the time of purchase, we would recommend that you should direct your queries through Bellway and I would recommend contacting the Solicitor who acted for you during the purchase as they may be able to help too. Of course we at Trinity will continue to make all reasonable attempts to police the issues and impose as much of a deterrent as possible, but to confirm, it is not within our remit or power to install gates as you are requesting. Kind Regards Charlene Charlene Brown AIRPM | Property Manager ----------------------------------------------------------------------------- ==== BELLWAY'S REPLY ==== We are in receipt of your recent correspondence to both Gerri Parker at Bellway and Charlene Brown at Trinity Estates in respect of the recent anti-social behaviour that has been witnessed at Arla Place. We note also the response from Trinity Estates following the submission of your petition set up requesting gated access to the development. It is of course unfortunate that we are corresponding in relation to this matter and that the actions of certain individuals can and have created an unsavoury environment by their selfish actions. It is indeed most regrettable that these individuals have chosen or target the development and are creating this environment, however in acknowledging the same it is also true to say that Bellway Homes could not have foreseen that these individuals would target the development in this way at either the design or planning stage and whilst we do not condone the actions of these individuals, Bellway can and have only constructed the Development in accordance with the planning and design guidelines set out for the development at the time. Further, our obligations under planning were to follow the design set out design to allow for Continuous link for pedestrian/ cyclist path to link commercial and residential development . Allocation of gates on both side of the development will restrict the criteria against S106. In essence part of the planning approval for the development was to provide public access from the leisure centre to the residential development and the installation of gates would be rejected and not considered by the Local Authority. We have not been unsympathetic to the problem and we have agreed to increase the provision of CCTV cameras these additions are taking place this week and recorded video footage is and will be available to Trinity Estates. The additional cameras will widen this scope across the development. In addition we are fitting additional bollards on the site to prevent vehicle access taking a short cut through the development along the link path from site to Victoria Road. We are and do continue to work closely with Trinity Estates and where appropriate we continue to assist them with managing the estate.
