Change Western Australia’s Discriminatory Surrogacy Laws!

Many couples are unable to have children because of Western Australia’s outdated surrogacy laws! Couples have missed out and had to give up on their dreams on becoming parents because of this. Imagine not being able to be a parent not because you’re not medically and mentally fit to do so, but because an outdated piece of legislation says so. Put yourself in that situation, how would you feel?
The surrogacy journey already involves in depth medical and counselling that goes for months before pregnancy even occurs to ensure parents are ideal to raise a child. So therefore the only thing that would be holding us back is Western Australian legislation!
Below includes information about current surrogacy legislation within WA!
WA laws regarding surrogacy are outdated and actively discriminate against adults and children. Did you know that:
1) It is illegal for Australian men to have children via surrogacy. This applies to both heterosexual single men and gay men. Western Australia is the only state where this applies and violates the equal opportunities laws.
2) Our laws make surrogacy so difficult for women and heterosexual couples that Australians are forced to look at international options. Resulting in 3 out of 4 Australian surrogate children being born through international surrogacy arrangements.
3) Our laws discriminate Australian children born through international surrogacy. Intended Parents are not automatically the child’s legal parents under Australian law. This means that the main carers for the thousands of children born via international surrogacy have reduced legal protections and may:
Not have the authority regarding their child’s medical care and education;
Not be able to travel abroad with their child;
Need to find and involve the surrogate in future decisions involving their child.
International surrogacy arrangements can take years of planning and cost in excess of one hundred thousand dollars. Intended parents spend their life savings for their dream of having a child. But this can be risky for everyone involved and there is no guarantee of having a child.
But there is hope. The WA government has been working on legislative reforms that will fix these issues since 2018, but we need these changes to happen before the end of the current term. These changes will encourage intended parents to have their children on Australian soil and put in place all the protections needed for children via surrogacy.
