The Criminal Original Petition No. 15133 of 2016 filed by Mr. Antony Rubin was listed before Hon’ble Justice P.N. Prakash in Court Hall No. 32. The Hon’ble Justice upon hearing the arguments advanced by the counsel for the Petitioner, S V Pravin Rathinam expressed his concerns over such a sadistic nature of violence exhibited by these Medical Students.
It was argued that Article 21 of the Constitution, while safeguarding the rights of humans, protects life and the word “life” has been given an expanded definition and any disturbance from the basic environment which includes all forms of life, including animal life, which are necessary for human life, fall within the meaning of Article 21 of the Constitution. Right to dignity and fair treatment is, therefore, not confined to human beings alone, but to animals as well.
Animal abuse is linked to future Child abuse, elder abuse and Domestic violence. Abusing innocent animals is the beginning of other violent crimes, as pointed out by many studies. Law enforcement experts have long considered intentional cruelty as an indicator of the potential for increasing violence and dangerousness, and studies have shown that many serial killers and mass murderers have a history of animal abuse. The same was substantiated with case law and other International Law Reports from Stanford and Boston Universities.
The Criminal Petition’s prayer is as follows:
A. Direct the authorities concerned to evaluate the Respondents Nos. 2 and 3 to undergo a thorough Medical Psychiatrist Test with a competent psychiatrist attached to the Government Medical Hospital or any other Hospital; or any other necessary medial test the Hon’ble Court may deem fit and submit the said report to the Hon’ble Court.
B. Direct the Respondents Nos. 2 & 3 to undergo Community Service in Blue Cross or any other society/organisation as the Hon’ble Court may deem fit.
C. Direct Respondents Nos. 2 and 3 to bear the costs of Medicine and Maintenance and future maintenance of the victimised Mongrel “Bhadra” and pass such other and further orders as this Hon’ble Court may deem fit and proper and thus render justice
His Lordship also queried the possibility of proceeding against the accused under any other act apart from the PCA, 1960 and the Indian Penal Code. After hearing detailed arguments advanced by the counsel for the petitioner, his Lordship was pleased to issue notice to the Respondents 2 & 3 viz., Accused No. 1 & 2 (Gautham and Ashish Paul) and has scheduled the matter for further hearing after two weeks.
