The Issue

The recent rules laid down in MP Judicial Services (Recruitment & Conditions of Services) Rules, 1994 prescribes the eligibility criteria for appearing in MP civil judge examinations as:

An Outstanding law graduate with a brilliant academic career having passed all exams in the first attempt by securing at least 70% marks in the aggregate, in the case of General and Other Backward Classes category and at least 50% marks in the aggregate in case of candidates from the reserved categories (Scheduled Castes and Scheduled Tribes) in the five/three years in Law.

He has practiced continuously as an advocate for not less than 3 years on the last date fixed for submission of the application.

It is arbitrary on part of the authority as there are numerous students who have dedicated years of hard work to their preparation for MP Judiciary as well as for students who have not practiced post graduation or do not possess the required academic qualifications.

Every law student knows how difficult it is to consistently pass all the exams without a backlog (there are reasons of infirmity, family, health, etc), it is also very difficult to maintain a 70% minimum qualification criteria because there is no uniformity in evaluation standards in law schools across India.
