The Issue

Our personal struggle began when my brother was unjustly placed under a professional guardianship. Out of our hands, he was moved to a nursing home, where our visits became scheduled and tightly supervised. Love and support, which he dearly needs, are rationed as though he is a prisoner. Beyond this, he has been heavily medicated and subjected to unnecessary medical procedures. This story echoes the experiences of celebrities like Wendy Williams and Britney Spears, whose plights have gained international attention and sparked outcry. Yet, what about the everyday people? What about families like ours, fighting in the shadows?

This situation isn't unique, nor is it rare. According to the National Center for State Courts (NCSC), approximately 1.3 million adults are under the care of guardians who control about $50 billion of their assets. Often, these guardianships reduce the adults' personal freedoms, even in situations where less restrictive alternatives could have been implemented. The systems in place lean towards professional guardianship over families without considering the potential for improved well-being or the wishes of the individuals involved. This legal structure can lead to complicated battles for families eager to assume or reassume care for their loved ones.

We must fight to reform these unjust practices and to tighten the regulations around court-appointed guardianship. Families should be the first consideration in guardianship cases, alongside the willingness and ability to provide care, rather than being pushed to the side in favour of professional services.
