De mai mulți ani, autoritățile publice centrale discută despre vânzarea terenului Stadionului Republican pentru construcția unei noi ambasade SUA. Pe 9 aprilie 2024, a reînceput procesul de negociere cu SUA pentru vânzarea fostului stadion. 

Noi, cetățenii RM, ne exprimăm îngrijorarea față de procesul de negociere dintre Guvernul Republicii Moldova și Ambasada SUA în Moldova cu privire la vânzarea terenului fostului Stadion Republican din Chișinău.

Credem cu tărie că un teritoriu atât de mare, un cartier cuprins între 4 străzi, cu o suprafață de peste 5 ha, situat în centrul istoric al Chișinăului, ar trebui să rămână o zonă publică și ar trebui să fie folosit în beneficiul locuitorilor.

De ce solicităm amenajarea unui Parc Public pe terenul Stadionului Republican?

 1. Terenul este un bun comun și a fost întotdeauna un spațiu public, în beneficiul locuitorilor. În secolul al XIX-lea a fost un spațiu public (Piața Fânului) care servea drept piață pentru nevoile locuitorilor. La mijlocul secolului al XX-lea i s-a conferit o nouă funcție publică: Stadionul Republican, cea mai veche arenă de sport din Moldova.

2. Terenul este amplasat în centrul istoric al Chișinăului. În tot centrul istoric, există doar două spații publice verzi: Grădina Publică și Grădina Catedralei.

3. Timp de aproape 20 de ani, pe teritoriul fostului Stadion Republican a crescut o vegetație generoasă de arbori, arbuști și plante ce îndeplinesc funcții importante pentru ecosistemul urban din mun. Chișinău: adăpostesc mai multe specii de păsări și alte animale, creează și mențin biodiversitate, prelucrează importante cantități de dioxid de carbon (zona se află în proximitatea uneia dintre cele mai aglomerate artere de transport - strada Ismail).
Acest ecosistem din centrul orașului ce se întinde pe o suprafață de cîteva hectare, întrunește toate caracteristicile unui spațiu verde, în conformitate cu prevederile Legii 591 din 1999 cu privire la spaţiile verzi ale localităţilor urbane şi rurale.
Ne raportăm la bune practici din contextul internațional în care alte orașe europene au demarat acțiuni de „resălbăticire” a orașului, adică de recâștigare a zonelor verzi, de readucere și reintegrare a naturii în contextul urban, precum și procese de reamenajare urbană în jurul pietonilor nu a mașinilor. 
Ne-am consultat cu experți/te din domeniu, am consultat experiența altor orașe și știm că aceste costuri pentru reamenajare sunt rezonabile și proporționale cu avantajele pe care le-ar aduce acest parc pentru oraș și locuitorii/oarele acestuia.

 

De ce NU susținem decizia de vînzare a terenului Stadionului Republican?

Această decizie este contrară cadrului legal al țării și contravine următoarelor Legi:

• Legii nr. 29 privind delimitarea proprietăţii publice ca bun din domeniul public al statului. Terenul Stadionului Republican face parte din bunurile domeniului public care, conform art. 5 (1), formează obiectul exclusiv al proprietăţii publice și sînt inalienabile, insesizabile și imprescriptibile, circuitul civil al acestora fiind limitat în condiţiile legii”.
• Codului Funciar al RM. Terenul Stadionului Republican este un teren de uz public. Conform articolului 47, pe terenurile de uz public ”se permite amplasarea construcţiilor şi amenajărilor capitale în conformitate cu destinaţia specială a acestor terenuri, precum şi a construcţiilor şi amenajărilor provizorii uşoare (gherete, chioşcuri), fără ca aceasta să fie în detrimentul terenurilor de uz public”. Întrucât destinația specială a acestui spațiu este de stadion, construcția unei Ambasade SUA nu este conformă destinației și nici nu poate fi considerată amenajare provizorie ușoară sub forma unor gherete sau chioșcuri.
• Legea 151/2018 prin care se permite vânzarea terenului fostului Stadion Republican către Ambasada SUA, a fost elaborată într-un context care, prin Hotărîrea Parlamentului nr. 39/2019, a recunoscut „caracterul captiv al statului Republica Moldova” din acea perioadă.
• Această decizie este contrară principiului transparenței în procesul decizional. În toți acești ani, autoritățile publice nu au organizat consultări publice, fapt care afectează credibilitatea și legalitatea întregului proces. Menționăm că, în conformitate cu Legea 239/2008 privind transparența în procesul decizional, autoritățile publice au obligația să consulte cetățenii în deciziile care pot avea impact social, economic, de mediu. 

Ce solicităm?

1. Abrogarea Legii 151/2018 care permite vînzarea terenului Stadionului Republican.
   
   
2. Trecerea terenului în proprietate municipală.
   
   
3. Stabilirea hotarelor spațiului verde de pe teritoriul fostului Stadion Republican și înființarea unui nou spațiu verde, cu statut de grădină publică în perimetrul str. București-Tighina-Ismail-Kogălniceanu.
   
   
4. Organizarea unui amplu proces participativ privind amenajarea spațiului verde. 

Credem cu tărie că un teritoriu atât de mare, un cartier cuprins între 4 străzi, cu o suprafață de peste 5 ha, situat în centrul istoric al Chișinăului, ar trebui să rămână o zonă publică și ar trebui să fie folosit în beneficiul locuitorilor (ca grădină publică, ca zonă verde de recreere). Cele 5 hectare din centrul capitalei deja au devenit un parc-pădure, cu importante funcții ecologice și sociale pentru oraș.

Terenul fostului Stadion Republican trebuie să aibă statut de parc și să devină deschis pentru toți cetățenii și toate cetățenele.

Из года в год центральные государственные органы обсуждают продажу земли у Республиканского стадиона для строительства нового посольства США. 9 апреля 2024 года возобновился процесс переговоров с США о продаже бывшего стадиона.

Мы, граждане Молдовы, выражаем наше беспокойство по поводу процесса переговоров между Правительством Республики Молдова и посольством США в Молдове относительно продажи земель бывшего Республиканского стадиона в Кишиневе.

Мы твердо верим, что такая обширная территория, район, ограниченный четырьмя улицами, площадью более 5 га, расположенный в историческом центре Кишинева, должен оставаться общественной зоной и использоваться в интересах жителей.

Почему мы требуем создания общественного парка на территории бывшего Республиканского стадиона?

1. Земля является общим благом и всегда была общественным пространством, служащим интересам жителей. В XIX веке это было общественное пространство (Рынок Сена), которое служило рынком для нужд жителей. В середине XX века оно получило новое общественное назначение: Республиканский стадион, старейшая спортивная арена в Молдове.

2. Земля находится в историческом центре Кишинева. В самом центре города всего два общественных зеленых пространства: Общественный парк Штефана чел Маре (или Парк Пушкина) и Сквер Кафедрального собора.

3. На протяжении почти 20 лет на территории бывшего Республиканского стадиона выросло обилие деревьев, кустарников и растений, выполняющих важные функции для городской экосистемы Кишинева: где обитают различные виды птиц и другие животные, создают и поддерживают биоразнообразие, поглощают значительные количества углекислого газа (зона расположена недалеко от одной из самых загруженных транспортных магистралей - улицы Измаил).

Эта экосистема в центре города, распространяющаяся на несколько гектаров, соответствует всем характеристикам зеленой зоны в соответствии с положениями Закона 591 от 1999 года о зеленых зонах городских и сельских населенных пунктов. Мы опираемся на передовой опыт из международной практики, где другие европейские города начали инициировать действия по "возвращению дикой природы" в город, то есть восстановление зеленых зон, возвращение и интеграция природы в городскую среду, а также городские проекты, ориентированные на пешеходов, а не на автомобили.

Мы проконсультировались с экспертами в этой области, изучили опыт других городов и уверены, что затраты на реконструкцию оправданы и пропорциональны преимуществам, которые этот парк принесет городу и его жителям.

Почему мы НЕ поддерживаем решение о продаже земли Республиканского стадиона?

Это требование противоречит законодательству страны и нарушает следующие законы:

• Закон № 29 о разграничении государственной собственности как имущества государственного домена. Земля Республиканского стадиона является частью имущества государственного домена, которое, согласно статье 5 (1), составляет исключительный объект государственной собственности и является невозможным к отчуждению, конфискации и пресечению сроков давности, их гражданское обращение ограничено в соответствии с законом».
  
  
• Земельный кодекс РМ. Земля Республиканского стадиона является землей общественного пользования. Согласно статье 47, на землях общественного пользования «разрешается размещение капитальных строений и сооружений в соответствии с особым назначением этих земель, а также временных легких строений (будочек, киосков), без ущерба для земель общественного пользования». Поскольку особое назначение этого пространства - стадион, построение посольства США не соответствует назначению и не может рассматриваться как временное легкое строение в виде будочек или киосков.
  
  
• Закон 151/2018, который разрешает продажу земли бывшего Республиканского стадиона Американскому посольству, был разработан в контексте, который, по Решению Парламента № 39/2019, признал "Государство Республики Молдова находилось в плену" в то время.
  
  
• Это решение противоречит принципу прозрачности в процессе принятия решений. Во все эти годы публичные власти не организовывали общественные консультации, что влияет на доверие и законность всего процесса. Мы отмечаем, что в соответствии с Законом 239/2008 о прозрачности в процессе принятия решений, публичные власти обязаны проводить консультации с гражданами по решениям, которые могут иметь социальное, экономическое, экологическое значение.

Чего мы требуем?
1. Отмены Закона 151/2018, который разрешает продажу земли Республиканского стадиона.

2. Передачи земли в муниципальную собственность.

3. Определения границ зеленого пространства на территории бывшего Республиканского стадиона и создания нового зеленого пространства с статусом общественного сада в периметре улиц Букурешть-Тигина-Измаил-Когэлничяну.

4. Организация широкомасштабного процесса участия общественности в оформлении зеленой зоны.

Мы крепко уверены, что такая обширная территория, квартал между 4 улицами, площадью более 5 га, расположенная в историческом центре Кишинева, должна оставаться общественной зоной и использоваться в интересах жителей (как общественный сад, как зеленая зона для отдыха). Эти 5 гектаров в центре столицы уже стали парком-лесом с важными экологическими и социальными функциями для города.

Земля бывшего Республиканского стадиона должна иметь статус парка и быть открытой для всех граждан и гражданок.

We demand the territory of the previous Republican Stadium be turned into a park

 For a few years now, central public authorities have been discussing the sale of the Republican Stadium site for the construction of a new U.S. embassy. On April 9th 2024, the negotiations with the U.S. for the sale of the previous stadium have resumed.

 We, the citizens of the Republic of Moldova, have concerns about the negotiation process between our Government and the U.S. embassy in Moldova in regards to the sale of the previous Republican Stadium in Chisinau.

 We strongly believe that a territory this big, a whole quarter encircled by 4 streets, with a surface of over 5 ha, situated in Chisinau’s historic center, should remain a public zone and be used for the benefit of the residents.

Why demand the arrangement of a Public Park on the territory of the Republican Stadium?

 1. The territory is a public good and has always been a public space, benefitting the residents. During the 19th century it had been a public space (the Hay Market) which served as a market for the needs of the residents. During the second half of the 20th century the space had received a new public function: that of the Republican Stadium, the oldest sports arena in Moldova.

 2. The territory is located in Chisinau’s historic center. Only two public green spaces can be found in the entirety of the historic center: the Public Garden and the Cathedral Garden.

3. Over almost 20 years now, the territory of the previous Republican Stadium has become host to a generous growth of vegetation such as trees, shrubbery and plants that play an important role in the urban ecosystem of the Chisinau municipality: they shelter various species of birds and other animals, create and maintain biodiversity, process important quantities of carbon dioxide (the zone is located close to one of the most congested transport arteries – Ismail Street).
This ecosystem in the center of the city extends over a surface of quite a few hectares, meets all the criteria of a green space in accordance with the provisions of Law 591 from 1999 in regards to green spaces in urban and rural localities.
 In reference to best practices in the international context, where other European cities have embarked on actions to “rewild” their cities, meaning the reclamation of green spaces, the return and reintegration of nature in the urban context, as well as the process of urban reconfiguration around pedestrians instead of cars.
 We have consulted experts from this domain, have consulted the experience of other cities and are certain the costs for the creating a park are reasonable and proportionate to the advantages the park would bring to the city and its residents.

 

Why do we NOT support the decision to sell the territory of the Republican Stadium?

 This decision is in contradiction to the legal framework of our country and contravenes the following laws:

·         Law no. 29 regarding the delimitation of public property as an asset in the public domain of the state. The territory of the Republican Stadium is part of the assets from the public domain which, according to art. 5 (1), “form the exclusive object of public property and are inalienable, unseizable and imprescriptible, their civil circuit being limited under the law”.

·         The RM Land Code. The territory of the Republican stadium is considered public use land. According to article 47, “Capital and temporary (kiosks, booths) structures and arrangements may be built on public use land, provided that these comply with the specific purpose of this land and are not to its detriment”. Considering the special purpose of this land is that of a stadium, the construction of an U.S. embassy does not comply with this purpose, and cannot be considered a temporary arrangement in the form of a kiosk or booth.

·         Law 151/2018 allowing the sale of the territory of the previous Republican Stadium to the U.S. embassy, had been drafted in a context which, through the Parliament Decision no. 39/2019, had recognized “the captive nature of the Republic of Moldova state” in that period.

·         This decision contradicts the principle of transparency in the decision-making process. After all these years, the public authorities are yet to organize public consultations, which affects the credibility and legality of this entire process. Worth mentioning is that, according to Law 239/2008 regarding the transparency of the decision-making process, public authorities are required to consult the citizens on the decisions that can have a social, economic and environmental impact.

 What are our demands?

1. To repeal Law 151/2018 allowing the sale of the territory of the previous Republican Stadium.

2. To transfer the territory under municipal ownership.

3. To determine the boundaries of the green space on the territory of the previous Republican Stadium and establish a new green space, with the status of a public garden in the perimeter of the Bucuresti-Tighina-Ismail-Kogalniceanu streets.

4. To organize an ample participatory process regarding the arrangement of the green space.

 We strongly believe a territory this big, a whole quarter encircled by 4 streets, with a surface of over 5 ha, situated in Chisinau’s historic center, should remain a public zone and be used for the benefit of the residents (as a public garden, a green zone for recreation). The 5 hectares in the center of the capital have already become a forest-park, with important ecological and social functions for the city

 The territory of the previous Republican Stadium must receive the status of a park and be available for all citizens.
