Tammy Gutierrez of Bakersfield, CA is one gutsy woman. It's clear that CarMax underestimated her courage, determination, smarts, and resolve. Big time.
First CarMax sold her an unsafe 2008 Hyundai Elantra with an unrepaired safety recall that could cause the brake lights and other systems to fail -- endangering her and others who share the roads. Then when she complained about problems with the car, they treated her with scorn. Eventually, she sued on her own, without having an attorney. CarMax fought back in court, and things dragged on for years. It's amazing her case survived all the legal wrangling.
Then she got legal help from attorney Robert Starr in Los Angeles. Now she's won a major ruling issued by a Court of Appeals in her favor, finding that CarMax violated California's Consumer Legal Remedies Act and Unfair Competition Law, which also prohibits unfair and deceptive acts and practices. Sweet.
The Court's ruling in Tammy's favor is widely considered to be the first Appellate Court decision over the widespread problem of car dealers selling unrepaired recalled used cars. The Court sent her case back to the lower court for further deliberations. It's been a long road, but one thing is clear: CarMax made a big mistake when it sold that unsafe car to Tammy Gutierrez.
