German & Colombian Foreign Office: authorize Laura to have custody of her daughter

The little girl is a 4-year-old who according to her mother and grandmother was abused when she was only a few months old. Laura, her mother, who has Colombian nationality, was herself abused from September 2014 to March 2017, when she managed to escape with her baby from the baby's father, a German citizen. 

Laura and her daughter live in Germany. They have been victims of domestic violence and sexual abuse under the guardianship of her husband and father of the minor, a German citizen*. (*As Laura’s testimony states)

Laura's Testimony:

Laura arrived in Germany in September 2014, with the belief that she would sign an employment contract, which never happens. This person confiscates Laura's documents and money upon her arrival. He mistreats her by restricting her outings, her access to money, her access to language, her ability to communicate with people other than her family (all interactions were mediated by him), and leaving her without food for weeks as punishment for not doing what he wanted. He also starts verbally, physically, and psychologically abusing her and sexually assaults Laura whenever he wants to.

Although Laura lost a baby because of this abuse, a little girl is born in early 2017. Laura's mother comes to help her with the newborn baby and witnesses the abuse to which her daughter and granddaughter are subjected, such as forcing Laura to return to work 4 days after leaving the hospital, withholding food, refusing to take the baby to the doctor, putting his tongue in the baby's mouth, touching the baby’s vagina and putting his penis on her face. They decide to try to escape no matter what, and finally, Laura manages to escape in April 2017 and is greeted by a women's shelter.

Currently, Laura and the little girl are in a vulnerable situation ever since the process has been taken to the German Courts. The German courts question Laura’s state of mind and capacity and suggest granting the custody of the minor to the father, who has been accused of abuse. The legal process has been filled with irregularities, such as limiting Laura’s ability to present evidence and witnesses, and invalidating Laura because she’s a woman, an immigrant, and is not fluent in the language.

Have they asked for help?
Lucia, Laura's mother, has tried to seek help from Colombia and Spain: she went to the Fiscalia in Colombia (Prosecutor’s office), who redirected her to the Colombian ambassador at the time. The ambassador told her that the only thing Laura could do was go to a church to ask for help. No Colombian governmental entities have helped Laura, the little girl, or Lucía to contact other entities or given any kind of legal support (until the moment of writing this petition). This request is therefore addressed to all the institutions that can help and warrant fairness in this case.

We ask that regardless of Laura's immigration status, her right to defense should be respected, in particular, to be able to intervene, present witnesses, evidence, and have effective legal representation that allows her to ensure the rights of her and her daughter. In particular, that they allow her mother Olga Lucia and her sister Ana Maria to testify, who have been eyewitnesses of the events that Laura has denounced in Germany, with the final intent of recovering her autonomy to continue raising her daughter without the constant fear of suffering abuse.

We need to make sure the little girl has guaranteed her normal development and growth in the company of her mother, as her sole family in that country.

In Germany, most cases of domestic violence reported against them and their children are resolved by Munchausen Syndrome, claiming that the mother is making everything up and is actually abusing her child(ren). Please help us so that Laura and her daughter's case does not go unpunished!!!
