(Calvin McKinney) - Help Fight Against Criminal Injustice

The Issue

Calvin McKinney is a young man that is a victim of injustice of a broken criminal system that has made him guilty of being innocent with no proof!!

Hope for an individual - Calvin McKinney who was 30yrs of age, at the time that he was wrongfully convicted for a crime he did not commit. I want to bring light to this specific case with hopes of an acquittal or a brand new trial.  During his first trial proceedings, there was a hung jury, meaning not enough evidence for a conviction. This whole case was based on purely circumstantial evidence.  There was only one commonwealth witness who identified Mr. McKinney in a photo array lineup just after 2 weeks after the incident took place and gave police an incorrect description of him, by being a 5'7 person wearing a winter hat that came over his forehead, black jacket, blue jeans with a light mustache in the chin area.

When at the time of the current incident - Mr. McKinney stood 6'4 inches tall with a full thick beard, even the photo array that was shown to the eyewitness Mr. McKinney was 18 yrs of age in that specific picture with hardly any facial hair at all.  The whole commonwealth case was based on a theory that Mr. McKinney had gotten into an argument with the victim at a gas station located in the city of Harrisburg. Mr. McKinney's girlfriend was present at the time of his incident and she recalled that it wasn't really an argument because Mr. McKinney was calm the entire time when this individual was accusing Mr. McKinney of looking wrongly into his car while being parked at the gas station. She even recalled Mr. McKinney even apologizing to the individual.

Due to a misunderstanding especially since Mr. McKinney did not know this person. The commonwealth ran with only that information as a motive and only sought after McKinney as the only suspect instead of doing their job as detectives investigating deeper into the case. There was no DNA, no firearm, or any fingerprints to link Mr. McKinney to the crime, just only a charge itself, but only for a shooting incident that happen in front of an eyewitness house two days before the actual victim died. The commonwealth used shell casings from the 2 days prior incident to match just a few castings from the homicide incident which was not a complete match.

But there was no eye witness to place Mr. McKinney as the shooter that day victim died, the person who was in the victim's car at the time of the homicide gave only a description, the same description that matches the first eyewitness of a person being shot was 5'7, 5'6 in height as the person who committed the homicide.  Again Mr. McKinney is 6'4 inches tall.  The key thing to prove Mr. McKinney's innocence is to go back to the technology of cell phone users and GPS mapping when an eyewitness observed the suspect shooting in front of her house.

The timing of call - was made at 12:22 pm when the 911 caller observed the suspect out her window, gun still in hand shooting up the street, meanwhile, Mr. McKinney was on a phone call miles away with a phone ping starting at 12:20 to 12:24 a four-minute call before the incident happened and during the incident, the eye witness identification to show and prove Mr. McKinney couldn't have been the shooter this day at 12:22 pm so just that in itself by using technology will discredit the eye witness identification. 

After both trial proceedings, Mr. McKinney and his attorney also recovered that Mr. McKinney was missing exculpatory statements from an important witness, as well as corroborating evidence to help better his case to prove his innocence.  That's why we're bringing light now to this case to get the recognition that's needed to help free this innocent man or even hope for a brand new trial with a jury of his peers.
