AB5 DOESN’T SOLVE THE DYNAMEX PROBLEM FOR BBC LICENSEES.

The Issue

AB5 DOESN’T SOLVE THE DYNAMEX PROBLEM FOR BBC LICENSEES.

OPPOSE California AB5

"....workers providing HAIRSTYLING or BARBERING services......The bill would require the State Board of Barbering and Cosmetology to promulgate regulations for the development of a booth rental permit and a reasonable biennial fee upon workers providing specified HAIRSTYLING or BARBERING services, by no later than July 1, 2021."

This is prime example of poor language written into law that affects licensed ESTHETICIANS in California.

As amended 5/24/19, this means that it would remain not in compliance of labor law for estheticians, nail care specialists and electrologists to rent the rooms and spaces they’re already working in.

This is a State of California Licensed POPULATION OF ALMOST 220,000 PROFESSIONALS, many of which operate as independent businesses within a salon environment. Circumventing this population doesn't fix the Dynamex problem; SALON OWNERS WILL BE AT RISK for labor violations and audits by the state, targeting them for significant financial jeopardy.

Why does the legislature exclude these categories?

It should be understood that all BBC licenses are equal.
