Breach of Data Privacy effecting Employee Career
The Issue
An employee started his career in 2017 and worked for a company A for 3 months and left the company due to health issues by informing the HR, and he didn't receive any relieving or experience letters as he didn't complete the probation period. He then joined Company B,C, then got an opportunity in Company D. He never mentioned experience of company A, any where to later companies. Now company D is insisted to produce the service history of UAN and got to know about Company A and insisting to produce relieving letter or experience letter to release offer letter which he do not have.
We can understand the companies measures of checking employee background, but it should not effect the career of innocent employees who never involved in unprofessional behaviors.
- Why Government of India, is not so concerned about employee data privacy?
- Without employee consent how can a company can view the employee service history
- Why Government of India, not controlling employers who are showing over smartness and impacting employee professional careers.
What should change:
- Employer should not be able to see employee service history, they should be able to see only the last company employment and companies can do BGC about the conduct of employee in the previous company.
- Employer should not ask for employee service history while offering a job.
- UAN portal should introduce a procedure if employee wants to exclude any record or modify the record in the service history by introducing certain verified procedures.
As the growing fake employees increases, companies are introducing certain levels of BGC's to eliminate them, but the innocent employees should not get affected by these. India should respect Data privacy of an employee.
As the number of employees who affected by these, and do not have an option to correct and their professional career is in danger, this change must be required in the society.
