Over 700 acres in Selle Valley, at the corner of Colburn Culver and Rapid Lightning roads, is being proposed to be changed 20-acre minimum to 10-acre minimum lots. This could have huge impacts to the area.
Doubling the density in the heart of the Selle Valley will open the doors for many others to do the same.
This zone change would bring more traffic, burden the neighborhood elementary school, degrade water quality in the Pack River, take working land out of production, and so much more.
This area was zoned for agriculture 20-acre minimums to preserve the agricultural and forestry heritage of this area. Approval for spot zoning should be denied since it does not qualify under the revised code. Owners should not be allowed to change their properties zone just because it’s what they want.
The applicant has asked for the zone change to:
"To allow the land owners to have usable options for the parcel, similar to the surrounding area."
According to the Bonner County Land Use (Title 12) Code, to qualify for a zone change, the change needs to be NECESSARY and impacts to the adjacent property owners must be considered. So, the effect on adjacent property owners regarding traffic, schools, natural resources and so forth, should be addressed. Desiring more options for land use does not meet the standard of showing the change is necessary.
From Title 12: 12-211: GENERAL:
A request for amendment to the text of this title, the comprehensive plan or to the zoning map must be accompanied by a written request that addresses:
A. Why the amendment is necessary.
B. The conformity of the proposal to the comprehensive plan.
C. The effect of the proposal on adjacent property.
D. Any other information considered by the Planning Director or Governing Body to be necessary for a complete evaluation of the proposal, such as information regarding utilities, traffic, service connections, natural resources, unique features of the land or off site features affecting the proposal. (Ord. 501, 11-18-2008)"
