Hi Everyone.

A quick report on what eventuated at my Bench Trial.

Sadly Murdock Hyundai prevailed, which to be honest, was to be expected in a state and legal system, that idolises and upholds 'At-Will Employment Doctrine'. Murdock essentially hid behind the veil of this doctrine, in an attempt to hide the wrong doings that were perpetrated on me and the judge declined to see the obvious errors and contradictions in Murdock's lies. Instead the judge wanted to keep the status quo of 'At-Will' employment.

Having said that. I think I won too. I can hold my head high and wipe my hands of the filth of Murdock Hyundai, because I was able to show on public record the type of sleazy people that run Murdock Hyundai.

Judge Robert Lund found; Because my direct reporting manager, Jason, denied my phoning him the afternoon of the assault, to notify him that I was going to the police. Then he couldn't have told Murdock Management that I had gone to the police, so therefore Murdock didn't fire me for the protected activity of reporting a crime to the police.

The problem with this ruling, is that Jason, merely said, he didn't remember and did not deny anything. In retrospect, we should have gotten the call records from Jason's phone. That may have helped, but may not have, considering the judge didn't want to say anything against 'At-Will' employment.

We had Jason read out in court, a note he had left on my desk, while I was working at Murdock Hyundai. A note thanking me for being on his team, how good I was, how friend;y and hard working etc. The note completely eviscerated the immoral and absurd arguments with which Murdock Hyundai tried to paint me with.

The portrait of me that Murdock tried to paint, was the exact opposite of what every one of my customers had said of me and what Jason Stites read to the court. The false narrative Murdock tried to push was actually laughable. EG, That I was the worst employee ever, that I constantly came to work smelly and unkempt and that I stole food from a staff refrigerator.

Every manager, Murdock had as a witness, lied through his teeth. I guess that's to be expected from 'company men', whose own livelihoods depend on the huge checks that Murdock pays them, from the massive profits they make on car sales. It's sad when people like Kasey Bingham, then my used car manager and now the manager of the Murdock Chevrolet store, totally lie about my actions. When I have audio recordings of him complimenting me on my sales, my work ethic and even offering me a job at the Murdock Murray Store (for which he was manger for a while). It's even more sad, when such a person, who talked me about church and family, lowers himself to such lies.

So the remaining question is, do I appeal this decision? There's a high probability of loosing, because it is so hard to have Utah courts make a decision against At-Will employment. I don't need to talk about how bad that is for employees in Utah.

I will appeal, but to find the appeal, I would probably need about $6000 to bring it to a "full briefing" for the appeal court.
