From a reliable city source: The city will rezone TIRZ 12 area, out of smart code. City manager (Tommy Gonzalez) will instruct staff to advise the rezoning. Need the city, on the record, to say the have no plans to rezone. Also... Possible to point to selling the public and council on the TIRZ *BECAUSE* it would be preserved through smart code. The city sold council the idea and the community the idea on the premise that smart code would preserve it. Told that staff would never advise smartcode rezoning and council listens to staff recommendations. We were given every assurance that rezoning would all but occur. Too expensive to develop under smart code. Several angles have been used: 1) back when they didn't want to admit they had illegally worked with a developer they said "not too worry, it's too expensive to develop no under smart code. We'd bet no one even touches it." 2) then, when we pushed and showed that they had plans slated it was "but don't worry. Your trails are fine. We're developing under smart code. This works with preservation." 3) then when it was posed that the city and it's manager can rezone or create code exemptions at it's discretion it was "but the staff would never advise any development in this area unless it was smart code. So the staff will advise that this land be developed under smart code and council listens to staff." They were going to exempt or rezone from the start. It's only profitable for a developer if they change the zoning. (Woody Hunt+Paul Foster combo)
