Day 5 - Update

I have been in contact with the Labour Relations Board and they are unable to follow up with this matter. See below what they have said with regards to online ballot voting: 

" Section 39(1) of the Labour Relations Code states that collective agreement ratification votes “must be by secret ballot cast in such a manner that the person expressing a  choice cannot be identified with the choice expressed”. Section 39(3) of the Code says that a vote referred to in subsection (1) must be conducted “in accordance with the regulations”. The Labour Relations Regulation does not address collective agreement ratification votes. Accordingly, the Code does not prohibit electronic voting for collective agreement ratification votes. This does not mean a union must use electronic voting: the union can choose the method of voting for collective agreement ratification votes as long as it is done in a manner consistent with the requirements in Section 39 of the Code and the union’s own constitution/bylaws."

When I asked them if BCNU will need to publish the results, I quoted this from their website: 

Section 39:

(2) The results of a vote referred to in subsection (1), including the number of ballots cast and the number of votes for, against or spoiled, must be made available to both

(a) the members, and

(b) the trade union and employer affected.

They said, "I would encourage you to raise these questions and concerns with your Union. Should you have any further questions about the ratification process, you could contact a lawyer for legal advice."
