Many employers are not handling situations of stillbirth or early infant death with any tact.
Leaving decisions about whether to honour parental leave in the hands of employers, opens up the possibility they will be disrespectful in what they say, as well as what they do.
Priya’s Mum was notified via a text message from senior management that her maternity leave was cancelled. Her question was ignored when she asked about getting leave for the full six weeks Priya was alive, and when we were caring for her. Priya's Mum's leave was structured by the company so that her annual and long service leave came before her maternity leave. So when Priya was born and living, Priya's Mum was using her annual and long service leave. Maternity leave should start from the day a child is born, if not before. When Priya's Mum asked for a formal review of the decision to cancel her maternity leave, the company wrote back saying that there was no legislative requirement for them as a business to provide the leave.
All these decisions were hurtful.
If the employer was not given a choice of whether to cancel her maternity leave, none of what had happened would have happened. Instead they could have politely passed on their condolences.
Other employers have been just as bad if not worse. One mum tells us that her employer told her that her maternity leave was cancelled because she "won't have anything to bond with”. As she says, this was “absolutely cruel”.
These actions can leave a scar. Leaving maternity leave to the onus of the employer is wrong.
Germany has recently changed the laws on this issue. Australia should too.
Labor has legislation already drafted from 2021, that should be reintroduced to parliament.
Yesterday was the 9 month anniversary of Priya’s passing. In our family any day we honour Priya is called "Priya Day". We try to do something special on the 14th of every month to honour our little Pri Pri ❤️. We had put the petition online on the 14th of March, the 8th month anniversary that she left us.
Even at such a young age Priya had a personality. The nurses used to call her feisty and sassy, because she would pull out her breathing equipment when it irritated her. Priya's Mum used to call her "Fighter Girl" and "Supergirl" because she overcame so many challenges she was put through. We will hold her in our hearts forever.
