The Legal Basis for Fighting Daesh

Besides being morally acceptable and within cultural norms, it is also legally acceptable for Australian Citizens to volunteer in the Peshmerga and YPG to fight ISIL/Daesh. The UK, Canada, Unites States, Israel and most EU countries allow their citizens, so why is it a crime carrying a life sentence in Australia?
Why? Because like in the Tom Cruise movie "Minority Report" the prosecution believes in that preparing for or intending to commit an offence is worse than committing one. They argue that it does not matter who or why you want to fight or for whom you will be fighting, its the fact that you were planning to do so is what is so heinous and serious that it merits life in prison and loss of citizenship.
Better to beg for forgiveness than to ask for permission?
