“After having reviewed the comparatives put forward by the prosecution and after listening to the submissions put forward by the defendant’s counsel I consider that it would be inappropriate to impose fines even though all of the comparatives referred to me imposed fines. It would in my view be also inappropriate to impose imprisonment by virtue of the fact that no person has seemingly been harmed by the product, as well as the defendant’s antecedents and the fact that in none of the comparatives was imprisonment ordered. In my view the appropriate way to proceed is under section 20(1) of the Crimes Act 1914 (Cwlth) and to release the defendant without passing sentence, upon his giving security on his own recognizance in the sum of $5000.00 that for a period of 2 years from today he will be of good behaviour and that he will not have in his possession any restricted chemical elements used in making the product or a similar product and that he will desist from promoting, making selling or otherwise dealing in the product or any similar unregistered product or assisting any other person from doing likewise except solely for the purpose of having the product approved by the TGA.”

The Magistrate, Mr Kilner appears to have dealt fairly with Bevan Potter in this case. Unfortunately though, Bevan is now forbidden to treat his own extensive skin cancer and must either now surrender to inferior and often dangerous and disfiguring conventional treatment or allow the cancer to run its course.
Magistrates can only deal within the constraints of existing legislation. It is up to us to act to have that legislation changed. Given this, plans are afoot to set up an organisation where Black Salve supporters can meet and work together to push for the appropriate changes.
