Australia is one of the only Western democracies without a nationally entrenched Bill of Rights. This absence has allowed successive federal and state governments to expand executive power with minimal restraint, often under the justification of emergencies, public safety, or administrative convenience.

Why

Without a Bill of Rights, Australians have no guaranteed protection for fundamental freedoms such as free expression, bodily autonomy, freedom of association, due process, and protection from excessive surveillance or arbitrary state power. Over the past decades, Australians have seen these liberties restricted, suspended, or overridden with little meaningful recourse.

What

We demand the enactment of a legally enforceable Australian Bill of Rights that clearly defines and protects fundamental civil liberties. This Bill must limit government overreach, apply to all levels of government, and provide real legal remedies when rights are violated.

When

This reform is long overdue. Temporary emergency powers have repeatedly become permanent controls, and rights delayed are rights denied. The time to act is now — not after the next crisis.

Where

This Bill must apply nationally, binding both federal and state governments, and be enforceable through Australia’s legal system to ensure accountability at every level of governance.

How

We call on Parliament to introduce and pass legislation establishing an Australian Bill of Rights, developed transparently, debated publicly, and subject to democratic scrutiny. Any such Bill must not be symbolic or optional, but legally binding and enforceable by the courts.

Australia’s democracy cannot rely on trust alone. Rights must be written, protected, and defended in law.
