Currently there is there is no prescribed period within which a delegate is required to make a decision in relation to DVA claims We therefore call on the House to request the Government to introduce the changes as outlined below to the appropriate Acts, specifically to all legislation for which the DVA are responsible for enacting, as follows…... 1. Within 6 weeks of an application for a claim being received at an office of the DVA in Australia, the Secretary shall (a) cause for a for a report to be prepared, and decision to be made, referring to the claimed condition/s; and (b) cause a copy of that decision/s and report to be served on the applicant. 2. That a maximum or two 28 day extensions be available to the delegate, provisional to the claimant being furnished a statement in writing setting out progress on material questions of fact, referring to the evidence or other material on which the delegate is basing his/her investigation (progress report). 3. That a maximum of an additional 1 week extension, be allowable to the 6 week limit in the preparation of the decision and report, for each additional condition claimed. 4. That should a new claim be made during the investigation of an existing claim, the report for the existing claim should not be served until the report for any new claim is completed. 5. That any delays, however caused by the claimant, be reasonable grounds for an extension, not exceeding to the length of the delay the claimant was responsible for causing.
