It's been over two weeks since the Court of Appeal issued it's ruling that set aside the decision to deny me habeas corpus back in 2015.
The matter was remitted back to the lower courts, but there is no sense of urgency in the matter. They insist that because I'm 'at liberty', the matter is somewhat moot.
My counterargument is that while I may be free to move about the province, I'm constrained by the matter to remain in proximity to the province and the Court house to have the matter resolved. My family has been broken up. Even though I have custody, my son is no longer in the care of either of his parents and I'm being denied the court ordered access. He has no idea where I've gone. I'm still dealing with other legal issues that have arisen since this process started and have been driven into poverty and sit at the brink of bankruptcy.
I've been trying to get the family matter addressed as contempt for months, but the same court that denied me habeas corpus is the one overseeing the family matter. Outside agencies have informed me the order is inherently flawed, but no one wants to claim responsibility for it.
There is a deep conflict of interest with this particular court house.
On Friday I had the first hearing regarding my original Charter application since January of 2015. Justice David Hurley, who presided over the initial application, was also roped into the habeas corpus matter. It was his ruling that was set aside. As a result, I had to request he recuse himself from the matter and hand it over to a different judge.
I'd rather transfer it to an entirely different court house.
If the matter continues to drag on, I will have to seek a lawyer outside the province to have this addressed by an international court.
