I will start by saying that I need everyone who is interested in pursuing this matter to chip in what you can afford to the legal fund right away. https://www.fundedjustice.com/StopTheAPSGreed If everyone who signed the petition donates just $10 each, we'll make the goal. I kicked in $50 myself and have donated countless hours to this battle thus far, but absolutely cannot keep going without help from an attorney (who I'll need to pay) or I fear our complaint will likely be dismissed. So PLEASE chip in what you can! One dollar - or a hundred. And please share it through social media too, as I have to prepare a response to APS within 10 business days (which I need legal help with) so time is of the essence.

The cliff notes from their response are as follows:
1. Respondent Arizona Public Service Company (APS or Company) requests that Ms. Champion be directed to file a more definite statement explaining the nature of her Complaint, or in the alternative, that her Complaint be dismissed.
2. Ms. Champion claims that APS violated a Commission order. Even assuming that Ms. Champion is refening to Decision No. 76295, however, her Complaint does not identify the nature of the violation. And although Ms. Champion's Complaint references several grievances against the Company, her general commentary does not provide grounds for a complaint.
3. APS's recent rate case was fully and properly vetted by the Arizona Corporation Commission. On August 18, 2017, after more than a year of public proceedings and thoughtful consideration, the Commission issued Decision No. 76295, resolving APS's general rate case, which included a rate increase.
4. Ms. Champion's Complaint contains several allegations, including that the recently-ordered rate increase has hurt "people and families," and that APS "is in violation of [sic] commission order...."
I think the hundreds of us who have seen MUCH higher bills than what they stated would be the "average," and especially those of us who have cut our energy usage significantly but are still paying much more - can bluntly say that their response is a giant load of bullshit. I'll save most of my words for the response I'll need to submit, but will really need the majority of you on board to give us a fighting chance.

Thank you all in advance, and for transparency purposes for those who donate to the legal fund, I'll be happy to share all legal receipts, etc. (I've also come out of pocket for nearly $100 just for printing costs too). If there is any surplus money, I will be donating it to the program at St. Vincent de Paul who paid my APS bills and deposit back in 2010 so my services weren't disconnected in the middle of summer with two little kids and pets at home with me.
