America’s Wine Laws Are Broken—Consumers Deserve Choice, Fair Prices, and Direct Access

The Issue

Right now, outdated alcohol laws block consumers from ordering the wines they want, force producers to sell through powerful middleman wholesalers, and prevent retailers from buying directly from wineries. The result? Less choice, higher prices, and a rigged market.

THE PROBLEM
Nearly every state still operates under the “three-tier system”—a Prohibition-era rule that requires producers to sell only to wholesalers, who then sell to retailers, who finally sell to consumers. What began as a safeguard against abuse has become a stranglehold on innovation and access.

CONSEQUENCES
Producers & Retailers Restricted: Small wineries, brewers, and distillers can’t sell directly to retailers. Independent retailers are forced to buy from a handful of wholesalers offering only a fraction of available wines.

Consumers Denied Access: Most states ban consumers from receiving wine shipments from out-of-state retailers, cutting off thousands of wines from the marketplace.

Prices Driven Up: With competition blocked, wholesalers raise margins while consumers pay more for less.
Corruption Encouraged: Wholesalers exploit their privileged position, lobbying to protect profits at the expense of fairness.


THE SOLUTION
It’s time to reform. Allow direct sales from producers to retailers. Allow interstate shipments from retailers to consumers. End the monopoly of middleman wholesalers. Reforming the system will:

• Expand consumer choice
• Lower prices through competition
• Support small and family-owned producers
• Encourage innovation and entrepreneurship
