Amend the Legal Services Act 2007 to empower CILEX members
The Issue
The recent case of Mazur v Charles Russell Speechleys has highlighted a critical gap in the legal framework that restricts Chartered Institute of Legal Executives (CILEX) members from conducting litigation independently. It is time for the government to amend the Legal Services Act 2007 to empower these qualified professionals further.
CILEX members are trained, skilled legal professionals who contribute significantly to the legal industry in England and Wales. Their qualifications and expertise are often on par with more traditionally recognised roles such as solicitors and barristers. The restrictions on conducting litigation undermine their potential to offer comprehensive legal services.
By amending the Legal Services Act 2007, we would enable CILEX members to take on litigation roles, thus increasing access to justice.
Let us call on the Ministry of Justice and the Solicitors Regulation Authority to take action immediately by reviewing and amending the Legal Services Act. The amendment would not only validate the capabilities of CILEX members but also create a more effective and equitable legal system for all.
