

Upon reading Delegated Report shown below, Doltone House have been caught destroying the Heritage of Pyrmont.
The before and after photos attached are damning!
Dodgy Private certifier appointed by a Doltone House who can’t seem to follow any rules.
Shouldn’t we all be asking…how does this keep happening!?

Development Applications
10. The following applications are relevant to the current proposal:
• P/2019/1853 – A Complying Development Certificate was issued by Modern Building Certifiers on 3 September 2019 for ‘Change of use from office premises to restaurant’ (seating capacity limited to 50 persons) along with associated internal fit out works.
• HWC/2019/446 – A Heritage Works without consent notice was issued on 6 January 2020 for repair and maintenance works of the building. Approved works include the removal of existing aluminium windows on the north-east and east elevations and replacement with reconstructed timber windows matching surviving original windows on the east elevation.
Compliance Action
11. The site is subject to an ongoing compliance action which is still being investigated and is relevant to the subject application. A complaint was received by Council on 16 June 2020 regarding the increase of the windows openings. Council staff conducted a site investigation. The investigation revealed that a CDC has been invalidly issued as the building is a Heritage Item under the Sydney LEP 2012. All work under the CDC to facilitate the change of use from an office to a restaurant has been completed. Works have also been undertaken to increase the windows openings on the northern and southern elevations without prior approvals from Council.
12. A Stop Work Order has been issued for all works being undertaken outside of the CDC and HWC/2019/446.
13. The Private Certifier has been reported to the Fair Trading for the issue of a CDC on a Heritage Item to undertake works.
14. It is noted that the applicant has indicated in the application that a Building Certificate will be sought for the unauthorised works following determination of the subject application. This will be subject to a separate application and assessment by councils Health and Building team.
