The Issue

In recent years, we've witnessed a concerning erosion of the foundational principles that govern the United States. The actions and decisions made by government officials, alongside certain judicial rulings, have highlighted a significant imbalance in power—particularly presidential power. This has been accentuated by recent court rulings and glaring corruption during President Trump's administration, which unfortunately signifies a growing trend towards executive overreach and corporatocracy.

The Citizens United v. FEC decision by the Supreme Court in 2010 was a landmark ruling that has had profound effects on American democracy. This decision has allowed unlimited amounts of money to flow into political campaigns, effectively drowning out the voices of average citizens in favor of corporate interests. When the financial might of corporations outweighs the influence of individual voters, the democratic process is severely compromised.

Furthermore, there has been a troubling trend of consolidating power within the executive branch. Presidential powers have expanded far beyond what the original framers of the Constitution imagined, leading to an erosion of the essential checks and balances system. This imbalance threatens the very fabric of our democracy and makes it imperative for us to reassess and recalibrate these powers to ensure accountability, transparency, and fairness in our government.

To address these pressing issues, we propose "The Checks and Balances Amendment"

The people and the States hereby affirm that excessive concentrations or abuses of economic and political power jeopardize our national and civic interests.

Part 1. No President or member of Congress, past or present, shall be immune from criminal prosecution for felonious misconduct. No such elected official may profit from their actions or knowledge therefrom while serving in that capacity, actions for which the judiciary may order proper restitution and proportionate penalties.

Part 2. No criminal prosecution or civil litigation may be initiated or advanced against a sitting President, for whom tolling applies. Corrupt obstruction or subversion of justice, quid pro quo corruption and material perjury shall also be grounds for impeachment. No President may self-pardon.

Part 3. The rights enumerated in this Constitution are the rights of natural persons only.

Part 4. Corporations and other artificial entities shall have no constitutional rights other than due process of law, freedom of association, and freedom of the press. The Congress and States may regulate the political and financial activities of any such entities and establish independent, non-executive agencies to govern their activities and the removal of officers solely for cause as provided by legislation.

Part 5. Subject to the provisions of this Amendment, the law shall support competitive markets and foster robust, accountable private enterprise.

This isn't just a call for reform, but a crucial step to preserve our democracy and the principles upon which our nation was built. We cannot allow unchecked power and corporate interests to dictate the future of our country, leaving ordinary citizens voiceless and disenfranchised.

Join us in advancing these vital constitutional changes. Sign this petition to let your voice be heard and help restore balance and fairness to our democratic system. Together, we can bring about the change that our country desperately needs.
