

Ocean Pines Association is an HOA formed in 1968, home to 12,000 full-time residents and 8,000 part-time residents and guests, who hold a 501(c)(4) exempt status with IRS. Their website states: “Amenities include a beachfront restaurant in Ocean City, and a public Yacht Club in Ocean Pines. There are also five pools, two marinas, a premier racquet sports complex, and a Robert Trent Jones Sr.-designed championship golf course. “ and “ The mission of the Recreation & Parks Department is to provide quality and cost-effective recreational activities, facilities, parks and special events that meet the needs of Ocean Pines property owners and residents. In order to fulfill its mission, the department offers a broad range of classes and community-wide activities. It also operates and schedules activities in the Community Center, parks, marinas, Beach Club and tennis facilities.“
The Ocean Pines Association offers access to its pools to the general public at rates that are considerably lower than the industry average. Non-residents can access the pools for a fee of $15, while non-swimmers are charged $3. An annual family membership is available for $850.
The association's membership fees for non-member access are comparable to those of municipal pools. For instance, the Juniper Swim and Fitness Center in Bend offers an annual family membership for $1,056.
It is important to note that commercial rates will never be nominal. For example, the SHARC charges an entry fee of $30 per person, which is not nominal.
Given these circumstances, it is crucial that an IRS investigation is conducted to determine how nominal fees are calculated, specifically in relation to Sunriver recreational facilities.
