A Resolution in Support of Parental Rights

Chico Unified School District Public and Charter Schools, Butte County, California.

 

A resolution to affirm the commitment of the Chico Unified School Board to the fundamental rights of parents/legal guardians to direct the education, health and well-being of their minor children.

WHEREAS, parents/legal guardians are in the best position to know their own child’s needs and circumstances, and have final authority over all decisions that involves the health and well-being of their children; and

WHEREAS, the fundamental right of parents/legal guardians to control the upbringing, education, moral instruction, and care of their children has been unequivocally established in the Constitution of the United States of America;[1] and

WHEREAS, the Chico Unified School Board acknowledges and reaffirms that all academic success begins by embracing these fundamental parental/legal guardian rights in our educational institutions; and

WHEREAS, it is essential that parents/legal guardians voices are respected and incorporated into the development of academic curricula to ensure that their children are receiving an appropriate education; and

WHEREAS, the Chico Unified School Board believes that the primary mission of public education must focus primarily on developing academic skills, and, without exception, should not include instruction in personal bias, race relations, gender theory, or other forms of political ideology, or indoctrination; and

WHEREAS, the Chico Unified School Board believes that any parent/legal guardian has the right to see and evaluate all surveys, data collection, and psychological assessments and findings with timely notice and parent/legal guardian written consent prior to being administered to Chico Unified students and that parents/legal guardians have the right to ‘opt students out’ of any or all such testing, survey participation, and/or data collection without not otherwise legally required, without fear, or retaliation toward any student; and[2]

WHEREAS, as a governmental entity in the State of California, the Chico Unified School Board recognizes that it must adhere to the law of the State of California in all of its practices.  However, guidelines issued by agencies of the state are not signed into law by the Governor are therefore non-binding on school policy, and as such remain within the discretion of the school board.  No policy of the Board shall be justified by guidelines that do not carry the authority of law.  

NOW, THEREFORE, BE IT RESOLVED that the Chico Unified School Board affirms  its ongoing commitment to the fundamental rights of parents/legal guardians to direct the education of their children, including the right to review all the curricula, programs, and guest presentations delivered to their children; and

BE IT FURTHER RESOLVED that the Chico Unified School Board, Administration, and employees will uphold the traditional partnership between teachers, students, and parents/legal guardians by directly communicating with and involving parents/legal guardians in the education programs of their children.

BE IT FINALLY RESOLVED that the Chico Unified School Board, Administration, and employees hereby declare this District is not subject to any practice not imposed by law which  might impede the full realization of inherent rights of parents/legal guardians, in the context of partnership and full transparency to enhance  cooperation between parents/legal guardians and School District employees, and will  adopt district policies that protect and preserve the sanctity granted parents/legal guardians under our Constitution of the United States of America.
