A Call for Justice: Petition to Enact Gender-Neutral and Equitable Laws in India

The Issue

​We, the undersigned citizens of India, unequivocally demand immediate and comprehensive reform of our legal statutes to enshrine true equality, fairness, and accountability for all. Our demand is simple:

Our laws must be FAIR, EQUAL, and STRICT—the same for every citizen, regardless of gender, with no privilege granted and equal responsibility enforced.

​1. Gender-Neutral Sexual Offence Laws and Absolute Accountability: 

​The law must be an impartial shield for the victim and an unsparing sword for the offender, irrespective of gender.

​Gender-Neutrality: Any law concerning sexual crimes, including rape, sexual assault, sexual harassment, or related offences, must be framed and enforced in a completely gender-neutral manner. The victim can be a man, woman, or any gender, and the offender likewise.

Maximum Sentencing: If any person—man, woman, or any gender—is proven guilty of such a heinous crime, they must receive the maximum punishment permitted by law.

Death Penalty for Rape: Specifically, for the crime of rape, if the law allows for a sentence of life imprisonment or the death penalty, this ultimate penalty must be given without hesitation to the convicted offender.

No Special Treatment: There shall be no special treatment or leniency based on gender. Crime is crime; an offender is an offender.


​2. Draconian Punishment for Proven False Accusations:

The willful destruction of an innocent person's life through a fabricated legal complaint is a profound act of injustice that must be met with equally severe retribution.

​Equal Punishment for All False Cases: When it is proven in court, beyond a reasonable doubt, that a person knowingly filed a false, malicious, or fabricated case—be it sexual, rape, criminal, civil, or any type of legal complaint—with the intent to frame or harm another:​The false accuser must receive the exact same punishment the innocent person would have suffered if convicted of the original, false charge.

This principle must apply regardless of the severity of the punishment, even if the commensurate sentence is life imprisonment or the death penalty (in the case of a proven false rape accusation).

Financial Redress: The false accuser must be legally mandated to repay every rupee of financial loss suffered by the innocent person, which includes all maintenance, alimony, fines, full legal costs, loss of income, and compensation for reputational damage.

Concurrent Criminal Charges: False accusers must also be concurrently charged with and prosecuted for severe criminal offences such as perjury, false reporting, and defamation, with the maximum sentence for each charge to be rigorously applied.

Strict, commensurate punishment is the only uncompromising deterrent that will prevent the gross misuse of the law to destroy innocent lives and ensure accountability for deliberate falsehoods.

​3. Child Custody and Maintenance: Prioritizing the Child’s Welfare:


​The foundational principle for all custody decisions must be the child’s stability, safety, and holistic welfare, not the financial demands or personal grievances of the parents.

​Custody Based on Financial Stability: If a parent petitions the court for child maintenance on the grounds that they cannot afford to provide a stable life for the child without financial support from the other parent, this constitutes a prima facie admission of their financial inability to ensure the child’s stability.

​In such circumstances, custody must be primarily awarded to the parent who can provide a stable life without needing maintenance support, unless the petitioning parent can demonstrably prove in court that, even without maintenance, they can fully and stably care for the child.


​4. Alimony and Maintenance Limits:


​The provisions for financial support must be fair and reasonable, preventing the financial ruination of the paying party.

​Fixed Cap: A fixed, statutory maximum cap must be established in law for alimony and maintenance payments to ensure they are compensatory and not punitive.

Mutually Exclusive Claims: The receiving party must be legally compelled to choose between a lump-sum, one-time alimony settlement or defined, monthly maintenance payments—they shall never be entitled to both.


​5. Fast-Track Justice and Enhanced Evidence Systems: 

​Justice delayed is justice denied—for both the genuinely victimized and the falsely accused.

​Mandatory Fast-Track: All cases pertaining to sexual offences and accusations of false complaints must be processed through dedicated fast-track courts with strict, non-negotiable timelines to eliminate years of legal limbo.

Enhanced Forensic Integrity: Forensic and digital evidence systems must be immediately and substantially improved, with strict procedural rules implemented to ensure that investigations are swift, scientifically accurate, and entirely insulated from manipulation.


​6. Uncompromising Equality and Consequence:

The very credibility of our legal system rests on the promise of absolute equality under the law.

​The law must serve to protect all genuine victims and justly punish all real criminals, without regard to gender.


​It must, with the exact same severity, punish false accusers so that every citizen understands this absolute principle:


​If you commit a real crime, you will pay the full, statutory price.

​If you ruin an innocent life with a malicious lie, you will pay the exact same, full, commensurate price.

​We demand these essential, non-negotiable changes now—to protect the innocent, ensure the guiltiest pay the ultimate price, and fully restore the public's faith in the impartiality and rigor of our justice system.
